Marvel Comics has lost the first round of its lawsuit against NCSoft and Cryptic, the powers-that-be behind City of
Heroes. Marvel's pissed that players can create characters who look a lot like their own creations. The judge dismissed
around half of their complaints; not a superficial setback.
It looks like the comics publisher shot themselves in the foot by offering examples of emulated Marvel characters that
they, themselves, created. Oy. If they wanted to prove that the game was hurting them, it would have been better
to track down players who are running around looking like The Punisher.
