The State of Delaware may consider an amendment (to the code
relating to videogames and obscenity) to hand out misdemeanors for selling M and AO games to underage persons.

Fear of being served a Class "A" Misdemeanor may still scare off retailers from carrying
mature games, however, regardless of the ESRB-rated basis for the bill.
Delaware now joins Illinois,
California,
Michigan, and
Florida
(with its recently announced bill) as a state attempting to legislate the sales—if not the actual content—of video
games. Which Supreme Court nominee is approved next could have a significant effect on the issue if any laws are
considered at the federal level (and if such a case is heard by the Court).
