We recently brought you news of a Chicago man
suing Microsoft over the glitches present in the 360
console. However, a lawyer looking at the case has provided some commentary and it seems the only real winners will be
the legal eagles involved in the case.
The plaintiff uses blogs and messageboards as proof of the number of people experiencing problems—unfortunately not
really proof enough for a court—and the timing of the suit may be too quick off the mark to be convincing. The lawsuit
claims that Microsoft have "failed and refused" to recall the 360, and yet it was only filed ten days after the North
American launch, scarcely giving Microsoft adequate time to act.
It looks like the lawyers had the suit ready and just needed a handy plaintiff to act as a figurehead for the
problems. This makes it harder for console manufacturers to take complaints like this seriously, as they know that
whatever they release, someone will pounce with a lawsuit as soon as they can.
