Actually no, if they don't have a patent, but can prove that they had that item out in the public, it becomes prior art, and the guitar hero controller patent becomes non enforcable.

I said "can prove that they had the item out in public". I should have said that "they can prove that the item was out in the public".

Also remember you need a patent to beable to start an infringement case, but in this case Ant isn't starting a case, it's defending itself. Totally different things.

I have been a practising viewer of The People's Court for many years now and just passed the bar by watching all the Alexander & Catano "The Heavy Hitters" commercials in a row for sixteen consecutive hours.

It is my professional fact that they are NOT S.O.L.

Something doesn't quite add up here. If Activision knowingly ripped off their controller, surely the last thing they'd want to do is sue them?

And if it is just a matter of the button placement and colours - which it is - TAC could end up opening a can of worms on what we'd then call "Colour button infringement" Watch out Sony, i'm sure i've seen those Dualshock buttons in a game somewhere before....

Somewhat pathetic that Activision would sue TAC after nabbing their button configuration, but also double so pathetic that they think it's worth taking to court.

I hope Activision lose, simply due to the pure irony in it all. Activision is obviously sore that TAC had the sense to come out with a wireless controller first, and obviously saw that as a threat. Don't be suprised if you see a wireless Guitar Hero controller packaged with their next game.

I love these petty technosquabbles.

But doesn't Guitar Freaks only use three fret buttons instead of GH's five? If thats teh case, then whats the point of having put 2 more frets on a controller designed for a game that doesn't have any use for them?

Sounds to me like TAC is just grasping at straws to try and save their asses, but since I don't know the whole of it, I'll reserve judgement.

The Guitar Freaks game is only tangently involved.

I thought something may happen when I read an interview with Harmonix in Game Developer magazine and the developer talked about buying hundreds of chinese guitar controllers to test Guitar Hero with until they got their controllers in. I didn't know that RedOctane (who manufacture the controller for Harmonix and publish Guitar Hero) actually visited the chinese factory seeing how they were made too. Wow.

Activision should have let sleeping dogs lie in this case.

So I wonder how TAC feels now that Red Octane put code in Guitar Hero II to prevent the TAC controller from working properly. How about all the consumers who purchased the TAC expecting they would be able to use the controller with Guitar Hero II. I'm seriously thinking about seeing if I can return both the controller and the game. I'm very dissapointed with Red Octane and have been a loyal supporter of them until now.
