Jack Thompson, you have a problem: Any five-year-old could go on to Amazon and preorder Halo 3 on their parents account and their parents would be fine with it. (Trust me 15 years ago I did!) JK. But I do have a point though, IT IS NEARLY IMPOSSIBLE TO IN FORCE WHAT HE IS SAYING ONLINE.

first off, whether or not little kids are playing halo3 doesnt depend on the producer of the game. the blame goes towards the retailer and the parents. i used to work for toys r us, and we designed the ESRB system. funny thing about that, we also failed the test when hit with secret shoppers. is that microsoft's fault too? listen here, cracky jack, put the blame where it goes.

See the funny thing is, Microsoft only sells their games to retailers not to consumers, and therefore any sane lawyer, or person for that matter, would understand that the retail outlets are responsible for this, not the publisher.

Why can't Jack Thompson understand this...oh right he's not sane. I'll stop right there.

He's 6 years too late. The only, ONLY REASON, he is going after Microsoft is because he can't go after GTA and he KNOWS that Halo 3 has a LOT of buzz, so it's a prime target to get PUBLICITY.

but how is Microsoft responsible for who buys the games I think he should be sending this letter to the retail stores and not Microsoft because Microsoft just makes the game and gives it to stores who then sell it to the people.

Ive been wanting to see the rating system enforced since they first started it back when Lethal Enforcers was taboo. I always thought if there was a clear line between T and M then developers could put whatever they wanted into a game and avoid all this media censorship crap like the 2LiveCrew mess in the early 90's.

But how do you enforce it over net orders? Are movies rated R not shipped to minors? I suppose its a fair assumption that to have a credit card youre 18. Then its the parents fault if they leave their Amazon account signed in so any 5 year old can just click and ship.

Anyway, M should mean something just like R or X. If somebodys kids get a hold of it after that its a issue with the family not the developer.

Jack hasn't played Gears of War has he?

Halo 3 is a kid's game compared to Gears of War. Halo 3 doesn't have dismemberment by chainsaw, curb-stomping, or human characters in multiplayer. Master Chief is more robot than man as far as I can tell.

Halo 3 is a game with practically NO REALISM that just happens to be a blast to play.

Playing video games does not train you to be a sniper! I would like to see the comparison of someone sniping on halo and then picking up a real gun. It's not the same. He needs to get a real job. Is it any wonder why are courts system is so busy, they have to deal with losers like this and their law suits. Go play lawyer somewhere else you aren't amusing us.

Personally,
I dont like playing with little kids online when it comes to my ma rated games. There annoying and lack skill. There is an easy way to fix this, its on Microsoft's Live network and people like this guy and the ESRB are gonna eventually tell Microsoft that it is thier responsabilty to make sure kids arnt playing these games on live. Again there is an easy way. I aint backing this guy up but I say get rid of the kids.

yes, shooting someone with a laser gun, and depleting his shields is really going to make a killer out of people. Why not go after Pokemon too? you're getting monsters to fight and kill other monsters...

by the way folks, Jack trolls the Kotaku forums regularily (moreso when it's a story about him) so if you want a chance to have him hear what you have to say check over there. I can never get their damn commenting system to work though. and Joystiq is better

Someone needs to make a Lawyer Simulator video game so we can all "train" to become lawyers like Wacky Jack. If one already existed I'd say that's where he learned his trade.

At the very least we should be just as good at it as he is.

my 5 year old son plays halo 1,2 and 3 beta-gears of war-and watches horror movies-he is a great kid at school and is very respectfull-so crazy jack should go after the nu tribe records who supports racism with songs like"kill white babies" instead of video games-what a fucking lowlife!

Hey Im with 12 and 13! If it gets these kids off of Live Im all for it.

Some of these games use skill filtering for matchmaking why no age filtering? Nothing really solidifies that "oh god Im a loser feeling" like knowing youre staying up playing video game with a bunch of little kids.

Age filtering now!

Maybe if some pervert molests a kid on his friends list we'll get some age filtering action.

I like the way old Jack is trying to challenge the biggest company in the world with the best lawyers money can buy. This man is in way over his depth.

Another interesting point. Halo 2 is rated mature, yet I'd be able to go down to the shop and buy it right now being under 17, that's because it's rated differently in the UK, yet it's the same game and people play it the same. Don't see any complaints there. I think Jack needs to realise people are responsible for their own actions. Blaming it on games is their choice, and their idiocy.

And like everyone else has said, this is not Microsoft's fault or Bungie's fault...but the irresponsible parents that buy these games for the kids that shouldn't be playing them.

And so what if that sniper used Halo 2 to "perfect" his sniping skills...he was still of the age of majority...so he could still buy the game anyways...

i just read the wikipedia article on this guy. what a complete douche.

but a few of you guys have made a very important point... it would be such a better online experience if little kids didn't meow in unison at the end of the game, pretend to be cursing, racist dinosaurs, and annoy the fuck out of me.

Videogames aside, it is very disturbing in my opinion to take the side of the giant corporation with a legal division that is larger than the division that handles the company's flagship product. "Any attention is good attention", and that counts for so-called 'news' channels out there. You guys, this is the exact same type of thing as if Fox News had hired Aunt Bea for 8 minutes to show watchers how to make bundt cake. It's harmless, made to be 'edgy' to instill the network's 'feel', and Thompson in his douchebaggyness is the man to go to for that.

...Not that Aunt Bea was exactly 'edgy'...although when she learned how to fly a plane..oooh! :)

Nice. Yeah I agree there were recently tons of complaints about the bible in Hong Kong. Definitely far more violent then most movies or video games. Oh but it has a message though so it's okay man this country has been hijacked by supposed conservative right wing religious extremists. I know the EB Games in my town is enforcing the suggested ESRB because I've seen them do it. I've also seen the following:

Kid: "I was that game mommy"!
Store Clerk: "I have to inform you that that game has a mature rating and may not be for children".
Mommy: "That's fine, I'll take it anyway".

Clearly Microsoft's fault.

Since when is t a media outlet's (much less the publisher who only deals with retailers and not end-using consumers) responsibility to control what someone buys? Shouldn't it be parents' responsibility to keep their children from buying "explicit content?" I'm tired of people in our society (Western not just American) always trying to blame an outside party rather than relying on good old personal responsibility. I'm tired of people expecting our governments, and now apparently retailers and publishers, to "make sure" that we do things "right." STOP THE BABYSITTER MENTALITY.

I always like to mention this on JT threads in case he's trolling them (which is likely since he has nothing better to do).

Jack, you accuse these publishers of profiting from tragedies all the time. Isn't it you who is profiting most by going after big name publishers just because they have money? I mean, everyone knows that they aren't responsible for these tragedies, but they have tons of money, so that makes them your target. Each tragedy give you another reason to get paid. So what's it like living off of blood money? If you are such a Christian, aren't you a little bit concerned by the fact that you are obviously going to burn in hell?

I've gotta agree with Jack, I do think that the beltway sniper trained on halo. I remmember there was a video of him jumping crazily firing off four rounds then switching to a pistol while yelling antisemitic slurs at people.

The beta is more T(Teen) then anything eals. The full halo game is rated M caues of the langage, and lightly for the flood (Gore but not real gorey like Res evil for example.

Also the system isn't broken, it's working fine. It's ment to help people make the right choice, not censore what people can play.
