Clones are one thing, but this is so alike that I think they'll honestly just get in trouble. They even stole the avatar style.

what's the legality of this?

i remember that guy who recently got a cease and desist for making a geometry wars clone and he wasn't even making any money

If you want simply the gameplay, without all the fancy graphics and music, you can get the homebrew game Luminesweeper.
