Class actions yield nothing other than rewards for the lawyers

Someone cite me a class action lawsuit where someone didn't die or wasn't medically harmed, where something came out of it other than a coupon for a rebate off a future purchase.

Also, 5 million is wildy excessive. At best, this person is entitled to a replacement game or a coupon off the cost for a replacement game.

Some people don't seem to understand this. No one has ever claimed that every 360 scratches discs so the fact that you haven't had a problem doesn't mean there isn't a problem.

My first 360 did this without being moved (I'm very careful with my electronics, especially when they're new) I just returned it to the store and got it replaced (along with the game). A very annoying transaction as I had to wait until there was a 360 in stock to exchange it for. My new one has worked fantastically for over a year now which makes me content.

I had my xbox scratch my 2 week old forza 2 disc, gears of war, and 2 copies of PGR3. I called Xbox and after a few calls back and forth I was assigned to a personal XBOX service technician. I can not say but great things about their customer service. They told me to send my XBOX back and then they send me (2) copies of PGR3, Gears of War and Forza 2. I can not complain. Still haven't got my Xbox back, but I have 2 so I am happy.

I just hope that we get a free disc replacement program out of this somehow, My 360 scratched my GOW disc to hell and gone, without me or anyone else touching it.

Err...i have 4 'boxes and none of them has ever scratched anything - even when I stand them up.

I have noticed noise like its going to scratch a disc when I move the 360 while its on, which I'm sure most of these people have done.

5 million dollars? sounds like someone is just getting money.

I would send them a new 360 and say suck it up.

I've never had a problem with my Pioneer car stereo and it definitely doesn't scratch discs. I don't understand what the fuss is about

first off i wanna say that I do not like the new layout. second off this lawsuit holds no credibility and will be dismissed by any judge with half a brain. don't move your console while it is reading a disc you f'in idiot. in all seriousness i would pay 5 million to kick the crap out of this moron

Gotta love those frivolous lawsuits and the retarded legal system that abides by them. What the F ever happened to common sense? 'My 360 scratched my discs ... it's ruined my life ... my wife left me ... I had a mental breakdown ... so gimme 5 mil dollars' ... right ...

If you have an Xbox 360 Console that has scratched your discs and you would like more information about the proposed class action lawsuit filed, please visit the Plaintiff’s attorneys’ website at http://www.Xbox360Litigation.com.

In the lawsuit, the Plaintiff is asking the Court to certify a nationwide class and create a fund for all individuals that have had discs damaged by an Xbox 360. The Plaintiff has alleged that the total minimum amount of damages incurred by all of the individuals combined is at least $5,000,000.00. To be clear, the Plaintiff is not alleging that he or any individual member of the class is entitled to that amount of money. The sum recovered by individual class members will be significantly less than the total damages incurred by the proposed class as a whole.

I know about 30 people locally with 360s. Twelve of them purchased theirs before I did in April 06. All 12 have sent theirs back for replacement, including some 3 or 4 times. For those who haven't, I promise you it is just a matter of time. I got the Red Ring of Death, and it scratched the Forza2 disc that was in it at the time. I called mine in to XBOX for repair on 07/25/07, and I was on hold for just under 2 hours. They told me it will be 4-6 weeks until I see a system. I spoke to a supervisor, but she told me that they have strict orders to only process these for repair. What kind of service is this coming from a multi-billion dollar company?! If we were buying a new car, the lemon law would have covered us. But instead of getting a new replacement one, they send us someone else's prior problem. Someone needs to file a class-action lawsuit regarding the console and not just for the discs that are getting scratched.

I recently got the same scratches and the exact same sound from a disk I was playing as seen at http://www.llamma.com/xbox360/news/Xbox-360-Game-Disc-Scratched.htm and the xbox was not moved It is the third disk that this happens to and i called xbox 360 support for the replacement of my system which is under warranty and they refused to give me a new one. By new one i do not want a refurbished one i really mean a new one. I didn't even ask for the reimbursement of the disk's that were damaged just the system being a new system. A New System After all the law suits being faught by microsoft a request such as mine should not be ignored !!! All it would take to avoid a third lawsuit in regards to this reccuring problem is a little bit of common courtsey to our problem and decent customer service. Anyone who would like to add themselves to my future lawsuit or inform me of their issues e-mail me at sizla69@hotmail.com
