The $60 Rock Band saga continues

[Update: Best Buy has sent an e-mail to all Rock Band pre-orderers admitting to the mistaken listing and cancelling the existing pre-orders. "We apologize for any inconvenience this has caused you. Because you are a valued customer, we would like to offer you a $5 Digital Coupon* toward a future purchase at www.BestBuy.com," the note reads, in part. Hey, it was always a long shot, but at least we get a coupon for our trouble.]
If you've been reading the updates to our story on the $60 Rock Band package with included controllers offered by BestBuy.com, you know that the site stopped taking pre-orders some time Monday night and took down the product entirely on Tuesday morning. Well, this morning things started getting really interesting.
BestBuy.com re-posted the product description pages for Rock Band this morning with a few key changes. The product description now clearly states that the drum, guitar and microphone accessories are "sold separately" and "optional" (Optional? We'd like to see them play the game without 'em!). These notes were not on the version available on the site from at least last Thursday through Monday night, as the above scanned printout clearly shows. Pre-orders are no longer being offered for the item, which has the same SKU and Best Buy ID number as the original posting.
So what about those of us that pre-ordered before the bait-and-switch. We called Best Buy and talked to a customer service representative who seemed just as confused as we were. First she checked to see if she could simply add the peripherals to the order but, unfortunately, BestBuy.com does not yet have the Rock Band controllers in its system (unlike Amazon and GameStop). She then checked to see if other orders placed on Monday had received any special consideration, but none showed any change from the original order. At one point she tried to argue that the original description may have just meant that the game merely supported the peripherals, but the printout we have clearly states that the peripherals were included (that one little word is key here).
We were then forwarded on to a BestBuy.com floor supervisor, Chris, who we walked through the whole situation once again. Chris asked us to fax the printout we made of the earlier version of the page and said he would forward the matter to their corporate headquarters. Chris said in situations like these the corporate HQ has to decide whether to amend the orders already placed or provide some other form of restitution to those affected.
Chris said he expected to have some sort of answer by tomorrow, and you'll be sure to hear about it as soon as we do. In short, don't cancel those pre-orders just yet. Joystiq is on the case!

Wow, this is pretty ridiculous. Somebody makes one mistake putting a website up, people jump on what they know is too good of a thing, and then complain when a company tries to fix it. I would be bummed out if I'd pre-ordered and then they gave me the option of canceling or getting just the game, but I'd understand. They brought in the game at the normal 360 price, and unfortunately, some versions of the product will be without that. God forbid somebody makes a mistake. What's going to happen if the orders get honored (or somehow compensated) is that some poor web programmer is going to lose his job. That's just ridiculous. That's like going into a restaurant that has a special written outside, finding out they are out of it, and then demanding that they give it to you anyway. Getting lucky is fine, but don't blame Best Buy if they say they made a mistake and correct things accordingly (though I can already hear the impending whining and claims of "I'm never shopping at Best Buy again!").

Such a fitting screen name. I love when people like yourself defends a company that has ripped people off or been shown to have unfair business practices. You make a mistake in this world you must be held accountable for it. If I lost some clients files at work here and another firm found them it would be my responsibility. Of course I should be fired because I failed at my duty and put others at risk! What about the loss this would generate and if it affected this saint of a web designers coworkers raises? Their pay and performance. Sir your views are naive.

I view this as payback for the time they "leaked" info about which games they were discounting in their system to the internets and had absolutely NOTHING on the list in store.
Anyway, if they don't honor the price I'm not going to raise a big stink, I'm just going to cancel my preorder. It's not a game I'd buy by myself for $200. But for $60, I'd gladly take the plunge. I wasn't looking to buy this game at all until I'd heard about this.

Ha, I had not noticed that my screen name (something which does not describe my situation at all) could be used against me in this case, and I give you credit, sir. It is chosen because it contains my name and last initial in order (good luck guessing), and I find that rather clever. I agree with Kye, Joystiq should not be supporting this behavior. We all know full well that this was a simple mistake, intentionally taking advantage of this is about two steps away from stealing.

anyway i got mine in roughly 20 minutes before they took it off, i printed out the receipt, order confirmation they sent me, and the original page that clearly says they are included with the game. I went through the same thing as joystiq, as the person i called seemed to have no idea what i was talking about, but eventually i got hold of someone that said i should get the instruments...i still dont believe they'll do it though lol

I'm bitter about the fact that I bought the dual guitar pack for GH2 360. Now I have 2 crappy guitars when such new sweet guitars are coming out. As I'm imagining the new Rock Band guitar will work with GH3 as well, I might just have to sell one, and let me guests play on the ugly white kid's toy. Man, that'll go over like a sky-diving walrus...

Why is this a story? Best Buy made a mistake and they'll cancel your order. They did the same thing when they accidentally made PS3's available on their web site. Granted, that wasn't a price mistake, but it was an availability mistake. This was obviously to good to be true.

I wanted the game to begin with. My experience with pre-orders were to only reserve a copy for you, but if they honor this I'll be happy, and if not then I'll have a guaranteed copy of Rock Band. I have a screen cap of the original page and the confirmation receipt. Well we will see.

I talked to a guy named Jeff from corporate and he said the offical coporate responce is 10% off the next order. He was very appoligetic and mostly pleasent to deal with. I wasn't very satisfied with that but the bottom line is that this was a mistake, after all we all make them from time to time.

If say just 1,000 people ordered it at $60 and assuming retail is supposed to be $200, BB would lose $140k. I'm sure even a huge corp would fight that.

It's stupid that this is even getting an ounce of coverage. People who screw the system like this only make products more expensive for everyone else in the long run.
It's one thing to take advantage a legitimate good deal, quite another to blatently abuse a known error/loophole. Here's hoping Best Buy laughs them out of the store when they show up to complain.

People happy about this are thieves. Just because you MAY think you have a right to take advantage of a mistake, and Best Buy is a large corporation, do not think it's in any way ethical to revel in some mistake made by somebody probably paid to do data entry.
You can justify it all you want, and I'm far from a choir-boy, but that just makes it all the more sad that somebody like me can see just how far morals have fallen in this country.
I know that other companies, if they make a costly mistake like this, will just say "sorry" and charge the correct price. That is their legal right, regardless of what wives tales you've chosen to believe. Hopefully Best Buy shafts all you opportunistic thieves and does the same. Fuck you all.

Someone screwed up and you want to take full advantage of someone's mistakes. It seems to be the America of TODAY's moto but it certainly makes me ashamed.
The more and more other countries bad mouth our ethics and morales, the more and more I let them with less of a fight because our youth does not respect the idea of working hard for your money.

Best Buy is under no obligation either legally or morally to accept these orders. And just to be clear (because it was once my job to know these things), acceptance of an order takes place at the time your credit card is charged. Not when an authorization is placed, not when an order is submitted. When your card is charged.
Even then, a retailer only needs to ship *or refund* your order within 30 days. They are still not under any legal obligation to actually give you the merchandise for the price you paid, although you could argue that morally they would be.
But at this point, they've done nothing with your credit cards or your orders. You've submitted a web form. That's all you've done. They have taken no action based on this, so at this point they're completely in the clear no matter what they do. They have no obligation to honor any order put into their system. No company does. It's time people learned that simple fact.
It's not like this is the first time a retailer or even Best Buy has made this kind of mistake. Nobody ever magically gets their orders when this sort of thing happens.

But here is the thing, it says that they will honor the lower of the two prices. Although its a normal mistake, they can say that for ALL PRE-ORDERS. So either way that question in the FAQ is a joke, if BB can just say, oops typo, sorry.
