(a) Thompson actually IS stupid when it comes to the law. I can think of at least a half-dozen instances of his legal documents that are on public record where he blatantly misstates the law. This is, in fact, part of why he's up on bar charges.

(b) You're categorically wrong about the speech issue: it's entirely constitutional to contract to limit your speech. What he's saying - and you misunderstood - is that you cannot be contracted out of your right to petition the government. He claimed that the Take-Two representative was saying that the agreement did this, but neither the agreement nor representative actually said so. The agreement validly prevents him from harassing Take-Two, and I hope they sue now.

I seriously think its all a show. His public persona is quite insane, but privately (and legally), Jack Thompson himself is more than capable of passing a psych eval.

Just proves he doesn't actually believe half the stuff he's saying.

Rockstar needs to just take him to court again. If he looses his job his credibility goes to zero and once politicians see people loosing their jobs. They'll be hush hush from that point on...

That's not enough to stop him. He needs to be disbarred, plain and simple. Take away his "authority" altogether.

I sit here, in the 3rd floor of our law firm, and shake my head in his general direction. I don't work in Consitutional Law as NATO may, but in a lower, less glorified ambulance chasing firm -- personal injury, as it were. And yet, Jack Thomspon makes our business look honorable. Thanks Jack, you've done at least one good thing today.

Oh, and we make people shut the fuck up all the time, BTW:

I love how whenever Jack Thompson is mention, all gamers suddenly group together as one big mass against him. It's one of the few things that Xbox and PS3 fanboys will agree on. Hell, you can mention Jack's latest adventures on a Counter Strike server, and for a few minutes, that guy with the most kills will stop calling everyone a noob and side with them.

Of course that's all wearing off as Jack becomes as old as the All Your Base meme.

@Nato, #1 a mall is not a public forum, its private. if you walk out of the mall, into the street you can scream "eat at Joes!" till you turn blue. #2 im not citing cases, like you said, that would take forever to argue this #3 you spend 90% of your post saying "youre wrong" in ten different phrasings, yet said nothing meaningfull to support your arguements. So dont get condesceding with me buddy.

@Duera. Your web anaglogy is an example of speech on a private forum, which is not what i said nor what Jack did. Of course if youre an employee and you engage in conduct thats not in agreement with your employers wishes, they can terminate you. (They can terminate you for practically anything if your contracts not guarenteed) However, they cannot prosecute you for excercising free speech on a public forum. Thats what Jack did, and thats untouchable. So yea, you missed the point with your example. And save the "ignorance" labels for when you make a meaningfull statement. thanks

@Rob. you can enter in any deal or contract you want. However, not if those agreements happen to infringe upon someones basic rights, they will not hold up in a court of law. For ex. you sign a deal (like Brock Lesnar did when he left the WWE) saying he would not work for any other wrestling or MMA promotions in the next 10 years. He broke the contract a couple of years later and the WWE tried to sue him. The judge (as many have done) ruled that the contract was not a legally upholdable because he has the basic right to make a living, and this agreement which he willingly signed, was not enforceable in a court of law. You cannot self your basic rights. thats my point, thats Jacks point. If he hacks into Take-twos website and smears them, thats one thing, but he can speak in public all he dam well wants. No contract can stop that.

I'm about to start business law for my acct. major and just skimming a couple pages in my textbook I think I could make better arguments or at least be on equal experience with Jack without having gone to the trouble of law school, which is sad. Sad I say.

Check out this youtube clip where jackoff thompson is debating about Counter-Strike causing that guy to shoot up his classmates at Virginia Tech. During this he actually referred to video games as "art imitating life." He actually called video games art. Quit being so hard on the guy.

The fairly accurate paraphrasing at http://gamepolitics.com/2007/04/19/breaking-grand-theft-auto-publisher-settles-lawsuit-against-jack-thompson/ is "will make any future contacts with T2 through its attorneys". How does having an exchange with "Gena Feist, Take-Two's VP and Associate General Counsel" constitute breaking the agreement?
