The terms and conditions allows Microsoft to deny you service WITHOUT CAUSE. I think its you who hasnt read it.

Why would they bother with this? What a slap to the face for their Halo fans. So this is where they spend their time? Instead of addressing a very serious issue with hardware reliability?
What will they do when 360's start crashing all over the place when this monster game comes out? Will they be to busy banning Live accounts to notice?
I am not flaming here, I just think that it is inevitable that a bunch of 360's will crash due to unusually high playtime with this must have of must have 360 games.
Priorities Microsoft, priorities.

What the deuce?, If Microsoft or Bungie wants to do this to avoid the spoilers they are doing it wrong.

This can't be true I mean remember Crackdown?, I got the game 20 days before it's official release and I wasn’t banned for that also that all the costumers got their copy in a legitimate way (Except for Ebay).

The problem with using a silver account is you are still connected to xbox live and can still be monitored through their systems. Anytime you connect with any of your accounts on your 360(weather it's the one you played Halo 3 on or not) your recently played list for all accounts will be updated on their servers. The problem with them banning is not a simple make a new account matter either. When you are banned from xbox live in this manner your MAC ID address is the thing effectively being blocked and thus your 360 is totally useless as an online gaming machine and you'll never be able to connect with it again unless the ban is lifted or you buy a new system.

They can't completly block your 360 from all live activity, because the EULA is on a per contract basis, and each gamertag is a different contract.

even the kid who managed to do the duping hack for the halo 3 epsilon and got banned for life on his gamertag could still get on with his others on the same console.

I'm just telling you exactly what I read from Microsoft for a specific ban. My neighbor was banned for "something" and it completely banned his MAC ID, he couldn't connect with any account or with my harddrive. He came over all the time to mooch off my 360 to get some gaming time before I moved into an appartment.

Nintendo's limited WiFi services don't sound that bad right now. This has the potential to be big news and only about 20-some posts? If it were a negative Nintendo story, there would be hundreds of posts condemning the company (especially by people who don't seem to own the console). 360 owners seem to be looking the other way here.

Hmmm ... a theory:

?aybe if you're MS and you don't want people to play early you 'leak' a story to the blogosphere via an anonymous rep that "everyone who plays early will be banned."

Then let it simmer in unconfirmed confusion for a few days, making folks paranoid and minimizing those who do play it, and then -- after a few days -- deny the story entirely.

Goal accomplished without any real bans.

I'm kinda sceptical about the legality of this. Unless there's a clear label on the box that warns you not to use this disk until a given date, banning someone .. I dunnno.. I'm no lawyer.

However I think the main reason for MS doing this is not so much to attempt to run around and beat people with a ban stick but rather an attampt to try and discourage people from getting / playing the game early.

If this announcement spreads it could help stop people from getting scammed by people selling 'that only real copy of halo 3' on Ebay for an obscene amount of money. It might help keep store workers from 'slipping an early copy' to their friends. In short making people hesitant to use the game early could make the situation easier to control for MS

Boy it would sure suck to win Halo 3 and have it sent the day before release. You know...the prize Microsoft and Pontiac are offering. You telling me they are going to check to make sure you won the game?

I wouldn't call it "big brother". You signed up to use THEIR network and by doing that you agree to their EULA in both the game and on their network; thus they have control. However, I do agree that if a sponsored distributor of the game released it early, then your account shouldn't be banned because at that point, not your fault. I would assume if you played it before release, and bought it legit, and you're banned. Then something tells me all you need to do is produce a receipt and after a lengthy process, your account will come back online.

Read my post clearly its says
"if you read it you know what they ban you for and what not"

I said WHAT they ban you for not what they can "defintely not ban you for", ofcourse they need a disclosure so they can add new rules and say this isn't okay, but as of time of writing they DON'T say they ban you for playing a game early

Again if you read bungie.net weekly updates they said they wouldn't ban you for playing a even if its there one early.

Wow thats crap, so if a store sells the game early and i play it i'll get banned? What if i didn't know they where selling it early? What if i thought they had permission to sell it early as a promotion? What if maybe Microsoft should be under control of their own product and it shouldn't be my responsibility to worry about it?

I remember i used to live by the Meijer that sold Halo 2 early in Michigan, had that game I believe about a week or so before release and everyone was like ZOMG! It even still had the DO NOT SELL BEFORE sticker on it I think haha.

i'm pretty sure you HAVE to sign into an account to play, otherwise the autosave function won't work.
I'm sure bungie has set it up that if you don't have some place to save progress, you can't play. Most games are like that on 360

The only reason that guy who got banned from LIVE was because the copy he had was PIRATED. He did not pay for his copy.
Halo 3 works perfectly fine in campain, you can't play coop until the officially turn on the servers, and the game is beautiful and plays just as nice as both the other Halo titles. If you are not buying it on tuesday and are planning to play something else, you are going to be missing a wonderful game.
That is my review.
