I couldn't have said it better myself LaughingTarget. For those who still don't get it, let me put it this way... One of the first things to go when the Nazis rose to power in Germany, was firearms, taken from owners registered on a pre-war gun list. Benito Mussolini, Joseph Stalin, and even China (both the Nationalist period, and Communist period).

I'm not a Republican (nor a Democrat), and I do not own any guns. I'm not some trailer trash redneck from down south. The right to bear arms is a necessity, unless of course you don't mind totalitarian governments, genocide, and oppression.

Yes, the man did violate the rights of another, but as anyone who does so, we utilize due process. The Firearms Act of 1934 was implemented to make it impossible for low income individuals to buy an automatic, $200 for the transfer fee was a year's salary for citizenry but easily avoided by mobsters, which the law was supposedly aimed at. The Gun Control Act of 1968 assumes everyone is a criminal and needs to prove otherwise, as does the Gun Owner's Protection Act of 1986, the Brady Handgun Violence Protection Act and the now expired Assault Weapons Ban of 1994. All of these laws violate the 4th Amendment (FFL holders are held to random, warrantless and unannounced searches by the ATF), 5th Amendment (due process of law and source of innocent until proven guilty, which all gun laws violate because the assume us guilty beforehand) and the 10th amendment which defines the people as individuals, not collective groups. This on top of the 2nd.

Furthermore, the Letters of Marqis section implies no restriction on the types or classification of weapons owned. The Congress cannot hire mercenaries if the citizenry is debarred the use of tools capable of handling the threat they are hired for. This means rifles, cannons, warships and even full automatics, tanks and private aircraft carriers. There exists no legal authority to restrict anything.

Final words, the best the Brady Bunch and other gun control groups can hope for given the state-by-state data on gun ownership in comparison to gun violence is that gun ownership and gun laws are unrelated to the level of gun violence. Being able to read at a 4th grade level has a bigger impact than gun ownership. So, the ultimate end is the laws are an empty expense and don't solve any problems. The resources wasted on the ATF every year are better spent on finding a solution to why people resort to firearm violence because the motivation remains even if the tools are absent.
