it's nice to root for the "little guy" I suppose, but 2k puts out the only MLB game for 360 owners, and even by the most gracious reviews, the games are mediocre.

My point was that the leagues as license holders decided to go exclusive with EA. I'm sure both the NBA and MLB were courted by EA, but they chose to go different routes than what the NFL, NASCAR, and FIFA did. That's their right as license holders to their own unique property.

If you hate having to choose between an EA NFL game or a 2k generic game, then complain to the NFL. Suing EA is a waste of everyone's time, as there's nothing illegal with buying an exclusive license provided by another company.

Here is a thought...:

All EA did was buy the NFL name. The names on the jerseys. The Stadium names. The NFL Logo. So on and so forth.
That in no way prohibited anyone else from creating a more competitive game. If so...how??
If you same it's all in the name...then you have to fault the gamer for basing the quality of the game based solely on the name.
Take-Two could have kept on with the series. Just without the NFL name. And that is exactly what EA will say.

That's just the thing though, maddenites want to play as the real NFL players and teams. This is why All Pro 2k8 failed (aside from other problems), and this is why the new Tecmo bowl games will fail equally

People want to play as the New York Giants, not the "Generic City Generics"

1:55PMAPF2k8 failed because it wasn't a very good game, plain and simple. It had many of the same faults Madden did, people just like to cry for it because it's the little guy now and because 2k5 was so good. People decided 2k8 was going to be an underappreciated gem before it was ever released.

That said, no NFL icense definitely hurt bigtime. They took a shot at the made-up teams thing with retired players and it didn't work.

Ironically, a while back it was EA faced with this problem when Madden 64 released without the NFL license. They chose to go the route of "copy the NFL without actually using the license" by creating teams like the Foxboro Patriots and South Florida Dolphins and they did OK. Not great, but OK.

This is the route take two should go. With as stale as Madden has gotten I think a lot of people would overlook minor differences like "Miami" vs. "South Florida" if the game was far better, but they are less likely to overlook "Miami Dolphins" vs. "totally made-up team with no NFL equivalent".

Yes, AMERICAN football, the games that $ells a $hitload even though its not liked all over the world like you're precious soccer. lol

Sorry for the $, just making a point. I'm a huge football freak thats all. I would think that the FIFA and other soccer titles would sell millions upon millions since soccer is a more global sport.

I wanna get Madden 2009 but don't know which version. It depends on which system my brother gets. He wants a 360 but he wants bluray. So, if he gets a PS3 yeah, I'll own you on this game too. ;) I haven't bought a Madden game since Madden 2006 so its been a while.

MLB and the NFL have completely different licensing systems. However MLB properties wants to follow the NFL so they can rake in millions from exclusive deals.

MLB still has a powerfull players union that prevents pure exclusive licenses. In the NFL you pretty much have to wear what the NFL tells you and that translates to a sigular entity for everything. MLB has authentic product but they cannot tell a player he has to use a certain bat or glove. Over the past few years they have raised th ecost of being an offical MLB product so high that they have almost forced all but the biggest companies out of the game.

All in all it is pure anticompetition and it should not be allowed. You can set a license fee but it should be open to anyone willing to pay and at a reasonable level.

Ridiculous. Freedom > quality of football games. Government has no right to tell the NFL who they can and cant license their trademarks to.

Not to go into a long rant about this but the NFL, MLB, NBA, and other major league sports are all privately owned (but usually tax revenue funded) copyrighted businesses. As long the owners and players are making money off people and licensing agreements, you can't force them to do a damn thing.

And they remind you each time you even watch or listen to an event that they control rights to what you are watching and listening to and any reproduction of the content is prohibit by LAW. Meaning you can't sue one company for getting the rights to use said names and likeness because another company didn't. That is how it works and way too much money is being made by copyright owners to change that fact.

But on that note, it may start showing how flawed the copyright and patent laws are starting to become.

I wouldn't call it flawed. You create something, you control it, no one has a say in what you do with that creation. If we up and forced content creators to open license everything, why bother creating anything with the nightmare of trying to keep all that under control.

It's easy for the uncreative to complain about copyright laws.

But creation is sometimes innovation of old concepts. But as innovation gets blocked when copyright holders block it looking for the all mighty dollar. I understand the necessity to be rewarded for the hard work and time spent to make what it is but at the same time there is a line between compensation and greed.
Sports use to be working man recreational hobby. Now its a billion dollar corporation for those who can afford it.

I understand what you say, but LaughingTarget has a point. In the end, even though we would all want it to be different, it's just like you having a shitload of money and someone demanding you do donate it to charity. It's your fucking money, rather likely that you deserve every single penny of it, so you decide.
