EndWar beta footage leaked

It's off some guy's television screen and the audio is horrible, but if you're itching to see what Tom Clancy's EndWar looks like, some naughty beta-tester uploaded a video of the game for all to see.
Now watch the video above and enjoy the fruits of somebody breaking their non-disclosure agreement (NDA). If the video suddenly disappears, the Ubi lawyer-ninjas probably got to it. Now we need to photoshop some lawyer-ninjas in case that actually happens. Watch ... while you still can.

If I were offering a Beta I would make sure that a very large portion of the screen would include a watermark of the individuals online ID.... Either that or some random sequence of numbers unique to each user that would look like random nothing to ID the person... not that I don't appreciate the leaks as a gamer but seriously they don't really think it through do they?

This RTS is hardly traditional, it plays fantastic with console controls and the voice recognition is pretty amazing. EndWar seems pretty unique among the RTS genre.

Agreed. Can't say much but I will be buying this game on day 1. The voice recognition alone is the best new control feature I've seen for a console since the Wii.

Its not whether the beta is that secret that matters. You agree to not do stuff like this when you join a beta. Seems that the guy isn't that bright to openly and obviously break an agreement.

I'm in this beta test and I hope to god they track this guys IP via Youtube (yes they can do that, he's broken a contract) and get him removed from the beta (and possibly charged). Normally I'm all for this kind of leakage, but it's a spit in the face to all the people who were desperate to get in and didn't because of the limited nature of the entries to turn around and do this - not to mention breaking a legal contract with Ubisoft after them being nice enough to do a private beta outside of their internal test team.
And yes, your probably thinking "well he's letting people who didn't get in see it" - but the fact of the matter remains, someone better who actually wants to support and improve on the beta could have got in, instead of some guy who just wants to post videos of it on the internet.
Let's hope he gets what is coming to him. It's really not on.

How do you know he isn't contributing to the beta in other ways? I doubt he just got into the beta to post a video of it, I'm sure he's giving them feedback and whatnot.

He wouldn't be charged with anything. He would be breaking an agreement, which is civil, not criminal. Either way, if they argued that sales were damaged because people got the wrong impression of the game quality from this leak, he could be in trouble.

Do free work? People ask to be in the beta. What they are given is not the issue. For a contract you have to have "consideration" in exchange for your promise generally. Their consideration was the ability to play a game before the rest of us. The contract is thus valid, and broken by them not following its terms. So, whether you see at as free work for Ubi or not - they had a duty to stick to their promises.

I know. I was mocking the OP with the bowing and scraping people do when they're involved in a closed beta. Like they have to tip toe around and play nice because they've been let into some exclusive club, when the club is really just unpaid tester work.
Case in point:

I'm also pretty sure there's a 0% chance they would actually go after this guy. What harm could this possibly cause? None. At all. Think about it. They just got a bunch of video game guys who are not the "general public" to watch a sketchy video of their upcoming game. If it sucks now, so what? They get most of their $ from people who couldn't care less about game blogs, and we'll be checking the latest posts (and gamerankings) to make sure it's good before we buy it. But if they can reel us in NOW by using these "viral" methods, then they get us too. Damn them!

Yeah, ok Robert, sorry to ruin the study break. Anyway, whether they choose to go after people is a different issue than if they could. The recording industry sues grandma's for letting their gk's download music on their internet connection. So please don't think that because the guy isn't rich, per assumtion, that he would be free from an attack.
BTW: Bar was no fun. GL & keep the nose down on the grindstone. The day after, life feels totally new.

They better take that footage down. Once the average consumer finds out that a Tom Clancy game is a RTS game and not a shooter of some sorts they will run for the hills.
