I did. I think the articles submitted by Methenitis are very insightful and good reads.

Of course, I'm applying to law school so this is down my alley of interest..

I have a buddy who is a trademark/copyright lawyer. He had to search the name "I Dream of Weenie" for a hotdog stand. As you can imagine, there were a few gay porn sites. Here's the kicker-- the hot dog stand owner was retired pastor whom he had to send all these porn sites to.

Good article. I'd like to see the trademark infringement column, for that is something that does come up, especially with as many third-party controllers and accessories as we've seen over the years.

This was a very informative post and it very much demystified the insanity of trademark regulations. As described the system sounds very fair and intelligent, which is a wild deviance from the US Patent Office way of conducting business.

Intresting article . I've been thinking about starting my own gaming company thing ,so this is good to know , my god-father is actually a copyright lawyer , so I could probably get through the process faster .

I'll probably have to try to get a few years experience before i try to start my company , or maybe I should just try to get a full-time job at Rockstar North , but they're probably swimming in resumes (they'd be conveinient tho , I wouldn't have to move that far away from where I am , and i have some family in Toronto too)

I have a mildly related question, though its probably more related to copyright and licensing.

If, for example, I wanted to set up a website with reviews, trailers, etc.. of games and/or movies, would I have to obtain permission in advance from the copyright holders in advance to show their footage?

Would it matter whether it was non-profit, ad-supported, or for profit?

Would I be allowed to obtain said trailers from other sites, or would I have to get them from the source?

Lots of blogs and games sites seem to repost trailers appearing on other sites without problems, but looking into the T&C of most sites it says that you aren't allowed to take their trailers.

However I tried emailing a few film companies about rights to use trailers, and I never got a reply. So where can I get them from?

And if I wanted to host them, on youtube, revvr, or almost any other site then their T&Cs say I must be the copyright holder. But what if I'm allowed to use it (either through prior agreement, or as fair-use for reviews)?

Or does everyone just turn a blind eye to all these issues when it comes to blogs?

I really love Mark's articles. I am an attorney who games, and for those who are not into his law articles, skip them. Pretty simple idea really.

Keep up the good work Mark. I spent a good amount of time looking into piracy and the law while at school (more so as it related to music), so I really like your articles. you do a great job of simplifying the material.
