So trademark infringement would be like utilizing the likeness of Mario for user icons on a website?

Nice intro topic to trademarks. What I find even more interesting is trademark use in-game. For example, if a developer wants to use a specific type of gun in their game, and it is going to be developed to resemble an actual product, the developer often needs to have the permission of the gun manufacturer. If a soda can in-game has a circle with blue and red halves, Pepsi would have a cause of action to sue for trademark infringement. I've heard of a helicopter manufacturer suing for the improper use of the design of one of its helicopters.

The big reason why real cars cannot be damaged/destroyed in most games is that Ford and other car manufacturers don't want their products, even digital versions of their products, visually destroyed. It's really interesting to see how trademark owners handle the video game world.

The gun thing always ticked me off. It's nice how in Counter-Strike the logs, console, and directory structure all use the real names even though the names in game are fake.

Another good example is the sink disposal company's lawsuit against NBC and the show Heroes. There's a scene where the cheerleader reaches into a running disposal to obtain her ring. Her fingers get all mangled, then healed.

Forgot the company name, but they sure were pissed about that scene. So much so that they filed a suit/injuction against NBC.

lol, The sink was the In-Sink-Erator, I remember because I have the same kind and I always thought it was a ridiculous name.
