Quick update for anyone who decided to stay up and sneak in a few games of (insert your multiplayer game of choice here). According to Major Nelson, the scheduled Xbox Live maintenance is running later than originally expected. Originally scheduled to end at 11:59PM PT, according the Xbox.com support page, Major Nelson says the team will have an update on the status at 2AM PT. Maybe you should hit the sack and dream of a beautifully performing Xbox Live for the morning because we imagine updating and reactivating a service with 10 million plus Gold and Silver members might take longer than anyone thought.
For more information on the Xbox Live service tune into X3F or keep an eye on the Xbox.com support page.
[Update: The service is now online.]
[Update: Microsoft's support page has been updated thanking gamers for their patience reminding this update is important as the company plans to roll out exciting new features - also known as the New Xbox Experience - in the future. Remember, this is not the new system update but an important stepping stone. Another update coming at 2AM PT as the Xbox support team works "around the clock."]

Dude, I may be a hypocrite by not doing what I'm about to say but it's just 5am. Get Some sleep and wake up to some Live goodness then.

It's just a couple more hours, plus the extra hours are during the times when less people are on Live. IMO its better for them to get it right once than to have to go back and do another update. Every time I complain and wish they just rush this update, I think back to last christmas when thanks to the influx of new users Xbox Live was crippled and everyone was having problems connecting. This year will be no different, a new price drop along with all the great games coming out this holiday will mean more new members than last year, let the xbox team do everything possible to keep the service running smoothly...its only a couple more hours.

In keeping with the terms of service, as this was regularly scheduled maintenance, the answer is 99.9% no.

Boo. Ah well, it's not like the outage interfered with my playtime - I don't go near the consoles through the week :)
