He says "A little reminder: If you get your hands on NXE and you are NOT in the Preview Program. You won't be allowed on LIVE." that doesnt mean ban, it most likely means we wont be able to get on live till the 19th as Microsoft and various other sources have confirmed.

Yeah. It sounds to me like you can't get on till the 19th. I reckon that Msft know they can't do anything and all Major Nelson is trying to do is to stop more people doing it my sounding like something bad is going to happen.
I'm not to bothered if my console gets blocked. Give me an excuse to upgrade from my original Xbox 360 to a Jasper (if i can find them)

Can you delete Achievements tho from this leak preview?

because I wanted to start it all over on Gears of War 1 and delete a few annoying games.

If so I don't got live and I willing to take the risk.

You can't delete them if you already have gamerscore in them. Only the ones that have a 0.

Well, I'm rather deadlocked on whether I should install it or not. I know I won't be getting any new games between now and the 19th, and Xbox Live isn't really a necessity right now for me. It also seems like there are an equal number of reasons of why Microsoft will NOT and SHOULDN'T ban you, and why they WILL and SHOULD ban you. So far, no official statements from MS say anything about a perma-ban, but who knows -- they could have their banhammers at the ready.

Actually its been leaked for months and months, its just easier to install now. But yeah why lose live for 3 weeks and risk a ban just for a limited dash?

I guess people will always do stupid things, all we can do is watch and laugh.

And yet, people don't see that you don't get banned. There is just not Live access until the 19th. I bet they have another update on the 19th for all the preview people. Regardless, because of there being nothing against the terms of use, MS won't do anything about it. I'll be installing it after I get the Banjo DL code and have it on my system.

downloaded NXE update but im not gonna use it on my 360.. no chance imma get myself banned from XBL for any reason.

nope, imma update a friends 360 that is never connected to live. i wanted to update his video codecs and ipod driver too but i dont think thats possible without XBL..

does anyone know if the NXE comes with the 'optional ipod support' driver or all the video updates that have been added over the last year? my friend's 360 still has trouble playing anything that isnt a WMV..

I don't understand why any one would WANT to get it on this early. If anything, I'd like to put it off till later. Honestly, the only interesting thing I see on this is installing, I ain't gonna use any of the other crap in there.

Like I said before in this Post...The chance of being banned is not worth the half backed NXE version the partial update offers. So do if you are that much of an impatient person and cant wait for another 17 days...lol
Well I need to be connected all the time so this is a no go for me. Please people just wait for the real deal not the half deal. The update is worthless if your not online connected. And yes I know about the install for your games and that is not enough to risk my Elite. For those that care and did it anyways ..... dumb move..Now even Kotaku is linking to this and Major's Twitter post..http://kotaku.com/5074010/and-now-a-message-from-major-nelson

IF YOU READ THE EMAIL SENT WITH THE INVITE, MN SAID IF YOU PUT YOUR HARD DRIVE ON ANOTHER 360 IT WILL UPDATE THAT CONSOLE AND WILL NOT BE ABLE TO ACCESS XBOX LIVE UNTIL THE 19TH.
IF YOU "BUY" A GAME BEFORE THE RELEASE CAN YOU BE BANNED? NO
WHAT MAKES YOU THINK THEY WOULD BAN YOU FOR WANTING TO SEE THE "FREE" NXE FIRST HAND.
GET THE FACTS STRAIGHT

PLAY GAMES OR PLAY CONSOLES JUST PLAY'EM

Hello Everyone!

Here's a tip for you people who want to try out the NXE now but still be able to get on LIVE for Gears of War 2 and COD5.

What you do is download the leaked NXE update and install the update. Try it out and get started on installing those games you play the most onto your hard drive if you have enough space.

Once you've enjoyed the NXE and want to get on LIVE, you will need to download the Fall07 update from Xbox.com. The link is... http://www.xbox.com/en-US/hardware/x/xbox360hddvdplayer/downloadredirect.htm

Once you downloaded it, install it and enjoy the old blade system while it last.

Sorry if I lead some people into thinking you get on LIVE with the NXE but maybe this will get some of you people to try it out before it comes out with worrying about missing out on GEARS or COD5 when it comes out. Enjoy

As someone on IGN stated, it´s not possible to "downgrade" the internal flash of the 360. So I guess we´re out of luck with that method...

quoting someone on TL:
"omg, everyone RUSHED to install the update, and of course trolls are going to say a ban wave is coming... now you are all frightened like little school girls...

I highly doubt a ban is coming, you ALL did Microsoft a favor and saved them some bandwidth for the month of Nov not only in downloading the update outside of the servers but also staying offline for 3 weeks. MS loves you right now.

So take a chill pill."

To those of you saying Microsoft wouldn't ban ANYBODY, think again. Using the old dashboard, go to the "System" blade, then "Console Settings", and once there go to "System Info". Open that, read the warning, and tell me that leaking the NXE was acceptable much less legal.

From how the warning sounds, Microsoft would have every right to ban the person (people?) that leaked the update. :o

Banning the person who leaked it sounds logical to me. But on the other hand, banning every single person who installs the leak is a bad joke imo!

I don´t see M$ do that...

They cannot ban that hero that leaked it because he's in the preview program, they said if you're not in the preview list, then they might ban you. There are thousands of people on that preview list so it can anyone. The software update is like any other there are no distinguishing factors that can identify it from another of the same updates.

The installation of the NXE works, I have used it to play GoW2 installed on the HDD, and I just installed GTA IV, very good with load times. There's nothing special about this update other then the ability to install games on your HDD, it's actually a hideous interface, I much prefer the more mature looking "Blade" interface.

well seems to me that u would get a fine for getting NXE early. just like: if u were caught selling a game (like Gears of War 2) before its launch date, which i believe is a $10,000 fine.
but i could be wrong about this, and becides who cares if u get the NXE a day or a fur hours early lol

The only part that matters is intact in this so called leaked update. So it's definitely worth it assuming you won't get banned if you EVER connect your console to the net before the 19th. Installing games should have been there from the start, so many disc($) would have been saved since the 360 likes to scratch them no matter if you bump into the console or not(which they lied and claimed is the only way it happens). That and the noise being exactly like a downloaded DEMO or game, nothing more then the fan. Wow, anything else from the update is a joke and is all about taking more of your hard earned money. Why still no way of downloading movies and songs straight from your PC? Streaming them from your comp is not only a hassle but makes you pay even more for electricity(M$). Then the joke of avatars, RARE needs to make Killer Instinct 3 not retarded looking people that make you look as a gamer like a tard that's going to get owned. AWWWWW!!!!

Whatever, like someone else said, you can just get the update off the net and install it with a USB drive and then connect to LIVE which you shouldn't have any problems with once the 19th comes. Installing the latest update, making the old update obsolete.

It used to be simple: pop a disc in, hit the power, the game starts.

NXE pops up an extra layer -- is that as an opportunity to throw ads at me, or just to delay that pop-start-enjoyment cycle?

Some of us purchased game consoles so we could GAME. I doubt any geniuses of the XBOX team are reading this, but it damages their core goal (GAMING) even though it's not the core business motivation (DLC and Ads).

NXE is a serious waste of time.
