Or, if your like me you have a kick azz surround with Def Tech BP7000,'s sitting within 5ft.....should I sue the game makers for putting in awsome bass when stuff blows up? Ive had this happen a few times and just take it in to get it resurfaced, problem solved for a couple bucks. Next!

the xbox 360 discs get scratched from playing the games too much so in this case, moving the xbox doesn't even matter.

This is the dumbest lawsuit ever. Just about any disc drive will scratch a disc if you move it tilt it while spinning. Shame on the idiots who decided it would be a good idea to move there 360 while it had a disc spinning inside it.

You guys need to stop sucking Microsoft's dick, the 360 scratches games without even moving the console. MS is a multibillion dollar company and they could of easily afforded to fix this issue before the 360 was released. The 360 could turn into a robot and kill your whole family and you guys would still say it's not they're fault.

What issue? It's not a fucking PSP. I can't think of one damn reason I'd move it from the shelf it currently sits on while the thing is powered on. Issues like the RROD are genuine. This one is ridiculous. Microsoft could afford to fix it, but they haven't exactly been making a lot of money in games until this generation. They could have thrown in the towel on games at the 360 launch after the marginal failure of the original.

He said nothing about moving the console. There's defective consoles that scratch the games when they're NOT moved.

The rubber pads on one side of the 360 fell of of my friends..it scratched his Halo 3 all to hell just because the 360 wasn't perfectly flat.

You guys making the argument about the warning in the manual do realize that not too long ago, there was a lawsuit concerning MySpace (I believe) and something in their Terms of Agreement, and the plaintiff won because she said that hardly anyone reads them? I'm sure you can make the same argument about the manual. It's common knowledge that a lot of people don't read the instruction manuals, like when it comes to video games. Hell, a lot of games don't even come with instruction manuals anymore, especially if you buy it used.

But yes, a slight tip in any direction will cause the game to be scratched, as mentioned before. When the Xbox 360 was first revealed, it was on its side, standing vertically. Microsoft later said that it isn't meant to be played on its side, since that presents the ultimate danger of causing said scratches on the disks. This is actually a case of negligence on Microsoft's part, because there were options available to avoid the scratching hazard. A safety option could have been implemented. It's like giving a lighter without a safety lock to a child with a warning label on the side about how dangerous it might be if used incorrectly. Sure, you can claim it was misuse of the product, but when you have the option of installing the safety lock, you can make a strong case.

All in all, what I'm saying is that this case can really go either way.

Just a note, a slight tip in any direction will cause it to be scratched. When you have all of these other consoles (aka 99% except the Xbox 360) have the safety feature where the disk doesn't get scratched if you move it, and only this particular console that does do that is having all these issues. The Playstation 3's drive reading speed is actually faster than the Xbox 360's, and it doesn't have this issue. This is why Microsoft has turned to hard drive installs in NXE to slow down the drive reading speeds to avoid this issue altogether.

I honestly think it's a little unfair to expect NO ONE to move the Xbox 360 for any reason and call them stupid. You really can't say there's not ever going to be a time this can happen. JMO.

My 360 completely ruined my copy of "Grand Theft Auto IV" with scratches. And no, I did not move the console while it was on. I just merely played the game.
What is worse is that it was a replacement console that was sent to me a few months before. Microsoft said that I was a few days past my 3-month warranty. Some people are not trying to just get a new console due to their errors. Many are just trying to get what they paid for. Microsoft refuses to replace my game and my console. That isn't fair.
Hopefully, this will fix their dirty way of running a business.

OMFG are people that god damn retarded? Just about any CD player you have if you pick it up and move it while it is spinning the disk will scratch it. I hate people, ignorant ignorant people. Especially like the story up one or two the kid shooting his parents because he couldn't play a video game, the kid should be put to death. There is no need to keep someone like him around, and the lawyer trying to blame stress and video games. Please bitch you should be shot too.

I've only had that happen once, when CD burners were first surfacing to consumer PC users. Accidently hit my leg against the tower, tower wobbled, disc was scratched.

I've tripped over my DVD player's wires, moved the PS2, Dreamcast, stereos...all of my discs have been fine.

So no, only a very limited few will scratch your disc as bad as a 360.

Considering it would've only cost Microsoft an extra $0.50 per console to put in the small rubber that would've saved your $60 game you just bought, what side should we really be on here?

My 360 has only scratched one game. It was....Gears of War. I took it back to Best Buy and told the girl it was like that when I opened it. :P

I work in customer service for a cell phone company and honestly people are idiots. Everyone wants someone else to fix their mistake. It's easy to say they are a multi billion dollar company, but if they step up and fix every dumba$$'s mistake they won't be in business for very long. It is easy to say Microsoft could have fixed it, but they did give the warning and it's your fault if you didn't read it.

Also, I think it's funny how there are people that never have a problem with electronics, and then there are the people that have a problem with everything they buy. Like I said I work in customer service and 80% of the time the problem is user error. Either people think the equipment is supposed to do something it doesn't or they are just idiots and don't know how to use it properly. I.Q. tests need to become mandatory and electronics should have an I.Q. rating on whether you are allowed to have them or not. If you aren't smart enough to work it, then you can't buy it.

I have alread gone through one scratched Forza 2 disc and last night the second one had its first read from disc error.
My console sits flat in a cabinet under my TV and is never moved. The last time I moved it is when I installed the wireless adapter. I would be afraid to move it while it is running.
Anyway, lieing flat without moving it has scratched a disc, which I took back to Gamestop and got replaced because it was under 30 days.

I looked at the picture... and thought,
"the only other way to scratch a CD/DVD that bad is to take my keys to it"

I believe that M$ made a mistake, and should be paying for it. They knew about the problem, and decided to not spend $.50/console to fix it.

The ps3 spins disks faster and when turned on its side does not scratch them.
Way to build a half finished PoS M$!
I feel sorry that people still buy this thing...

I have never moved my console while playing, it's difficult enough to get my ass of of the couch. Seriously I now have 5, 360 consoles all out of warranty that have broken down in some way (RROD, failed DVD units etc etc). I refuse to pay Microsoft any more cash, they should do the decent thing! I have played xbox (old black one)since it first came out and have spent approx £8,000 on games, headsets etc. NO MORE SHODDY CRAP FROM MICROSOFT!!!! FIX YOUR MISTAKES PLEASE!!

This problem ruined my skate 2 disc. I had nothing to do with it. Papa dukes tripled over the Ethernet cord whole just walking around. 360 tips, my game doesn't work. Microsoft should be held accountable. They have billions. They're games are 60$ a piece, I don't have billions, either. I hope whoever sued wins and microsoft us forced to change they're design. It's bullshit. And they are charging people to replace the discs?? That's even more evil. They are greedy as hell. Shoulda got a ps3.

I purchased My sons X-Box 360 in December 2006. The Console failed within one month. A replacement was exchanged. we discovered real fast you don't move the counsole while a game is spinning. We did get to play frisbee with that $60.00 game so it was'nt a total loss. After a year the warranty was expired. We opened the counsole to see what was scratching the game discs. You see my sons X-Box 360 was scratching games with no movement on the counsole. I added soft felt pads around the discs playing area. This helped to stabilize the spinning disc and helped immensely. However, The housing that holds the Lens Reader itself was still scratching the games. This is clearly a design fault. Microsoft is a Multi Multi Billion Dollar company. There is no excuse. They could have addressed this issue when they released the new Elite Console. I doubt they will fix it in the future. You see there are a percentage of buyers that will just suck it up. Go right out and buy a new copy of a game. Why? Because if you want to play you are gonna PAY. With the upcomming release of Resident Evil 5 X-Box sales have surpassed Playstation & Wii. There will be a huge increase in game sales, And With that more will be replacing their SCRATCHED GAMES. Microsoft makes more money this way. They are in no hurry to fix this problem.

My 360 has never ever been moved since setting up and now after 5 months the thing is chewing discs and the retailer blames me! This is the second 360 I am on after the graphics processor went awol. Microsoft stinks, I'm gonna buy nothing but Apple stuff from now on, my ipods/iphone have been brilliant

360 = a big piece of crap!
