Mario Kart: Source PC mod uses 'the best parts of each' MK game

You don't have to tell the crew of people painstakingly piecing together Mario Kart: Source that there's a much easier way to play Mario Kart games on PCs. Sure, they could fire up an emulator and play Mario Kart 64 and it would be just like it was way back when ... but where's the challenge in that? What they could (and did) opt to do was take Half-Life 2's flexible Source Engine to create a Mario Kart mashup; the project manager says, "We're not simply recreating one version of MK, but using the best parts of each." It's a Franken-kart, if you will.
Eager to get a closer look at it? Peep the gallery we quickly threw together, or dig around the project's official site. Want to actually play the thing? Says the project manager: "As far as a public beta is concerned, we will not release anything until we are satisfied ..." Either that, or until Nintendo's army of well-paid lawyers shuts the entire project down.

God Damn it! Why report or share these great things so early?!?! Don't share/report these projects until they are done, and can then be gotten via P2P with nothing Big N can do about it. Now those good graphics hating ass tards at Nintendo will shut this down.

If modders/developers were to distribute a final release that was as finished as it was going to be, it would allow the rights holder a much better chance at taking them to court for actual damages and ruining their lives. You can't just say, well I released it, took it down, and now it's not my fault that the internet still distributes it. That doesn't fly in court and they'd be at the total mercy of the rights holder and its [rightful] rights.
The fact remains that doing and releasing these homages are pointless if you make them public. Whether you get shut down on one end or the other doesn't seem to make a lick of difference in the end. If it's good enough, it will get shut down either way and if the damages outweigh the bad publicity the punishment will be made [See Liksang.com Vs. Sony (Not exactly the same but its something)]
However, this is hardly a threat and it pretty much depends on the lawyer on duty for the day and whether he/she feels like being an ass.

bm - that's not true at all. Some real work goes into a lot of mods because if you make a really good one, then you're quite likely to get hired into the industry.
I think this looks excellent, and I don't think it'll do any real harm to Nintendo. Hell, you could ban their franchises in half the world and they'd still be unstoppable.

I thought that was the problem with the Starcraft DS remake; they were using directly lifted sprites. If these guys make all their own resources from scratch, how is this different from making your own fanfiction comic book?

Well, i have been following this one for a couple of years, if you think about this really, they are not doing anything wrong, because the mod is free. I would like to have a talk with every gaming website that says otherwise.
Hell if anything this is better then the last 2 mario karts, because they will be actually improving the gameplay, if this get shut down i am not going to ever buy another nintendo product,and will convince others to do just the same..... you can rest assure that. thats coming from a person who has bought every system since nes.
i mean whats the fun of mario kart when you know a turtle shell will die out in about 4 wall bouncings, its much more suspenseful if shells keep on bouncing, that is just by far lazy on nintendo for designing it like that.
i feel this game is worth a fight for and i will not let that down.

Really? You've owned every Nintendo system since the NES and you would stop buying Nintendo items and convince others to do so as well because Nintendo shut down a Mario Kart mod? If someone downloads this mod, they have a reason not to go out and buy Mario Kart. Therefore, big N would want to shut it down.

With all the work they've put into thism and how awesome it's sounds, I hope Nintendo at least gives them a chance to parter up with them and sell this game on Steam for like a dollar.

The thing with this game is that it allows users to upload content and host their own servers and playerworlds and such. At one point they had some Yoshi images and other Nintendo related things in there, and Nintendo followed with a lawsuit.
The result of the lawsuit was that they had to remove all the Nintendo copyrighted material from the game. That was pretty much it. Nowadays the game is still around. So they might force these guys to change all the Nintendo copyrighted material in game to something original, but that's about all they can do.

Even if the game doesn't use a single bitmap or texture taken from Nintendo's games, there could still be a copyright violation if any level design or other creative aspects of the original games have been reproduced.
Furthermore, having identifiable Nintendo-owned characters like Mario, Bowser, et al within the game is a pretty clear trademark violation, even if there is no copyright violation. It's tough to say just how much they'd have to tweak the characters to be clear on that point; would we even be discussing this game if it was "Great-Giana-Sisters Kart: Source"?
