"To get to the basic theory of the IRS in the US, the short version is 'all income is taxable.'"

All income, or all income that can be assessed? Therein lies the problem. You can't put a price on something that can simply be destroyed week-to-week by the fake-economic whims of a game company.

I agree with your solution though. A cash-out system which can then be taxed...and banned by the relevant game company's TOS.

Your house, your car can all be destroyed. That's not the problem.

Gov. Paterson is already proposing to begin taxes on all virtual goods and paid for program downloads for Sales Tax. Here in NY he's doing what he can to help settle our huge budget the state has. Even Amazon just lost its case in regards to having to charge NYS Sales Tax on its goods sold to anyone in NY. The State is cracking down hard on this now.

And yet in my opinion, no matter what they do, we'll still hear about some budget issue in the years to come. All they are doing is feeding the monster more and not putting itself on a much needed diet. I rather they lower all the ridiculously high salaries they pay everyone in the higher state government for not doing anything in reality but sitting on their asses while all the lower level personnels do their job.

+1.

NYS is full of shit. They need to cut spending, including all those overcompensated MTA board members and executives. Instead they keep raising fares, cutting service, and raising taxes.

I need to move to Wyoming or something.

This is all made more hilarious by the fact that the income tax has no basis to exist at all. It's also infuriating that the government is so desperate for money that they would start taxing fake money. What's next? A 10% tax on your monopoly money income?

I understand that some people do make a small income from transferring virtual money into real money, but the vast majority of players out there don't.

SL has a big real estate front that shuffles around quite a bit of cash. Some people make 6 figures on rent in a year.

"I understand that some people do make a small income from transferring virtual money into real money, but the vast majority of players out there don't."

The richest 10% of the worlds population owns over 80% of all assets. The majority 90% doesn't make much so we shouldn't tax anyone? I'd love to see roads, libraries, schools, parks, etc. get built with those tax dollars.

it's already happening in WA, we pay taxes for online goods (even on PSN and Xbox Live) depending on our zip code.

If the IRS wants to tax your profits in Lindens, then shouldn't you be able to pay your taxes in Lindens?

I've been patiently waiting for an SL-related evasion or failure to pay case to come across my desk. I'm sure it's just a matter of time.

I'd prefer the IRS treat the SL avatar as a foreign citizen and the income as a foreign-earned and only tax the transfer of funds from the foreign entity to the US tax-paying entity, if they want to handle this under the federal scheme. I think it's best handled under a state tax scheme though.

One thing is for sure - some tax man will get paid in the end. Whatever it decides, the IRS should move quickly. I'm sure people are taking advantage of this right now but it would be a very tough wilfullness argument right now given the flux.

So if I make $1 billion dollars on capital gains, I pay 15%, whereas if I make $50,000 in regular wages or by selling WoW characters, I pay more than 15%? I call bullshit.
