Idiot. You don't check something like that. Put it in your carry on bag. I've done it, there is room if you pack right.

So stupid to put something like that in checked luggage.

Yeah, I always carry it on, any and all my systems when I travel. I rememberw hen the Wii first came out and the lady thought it was a bomb, took me to the side and everything. It was bananas.

I'm sorry, but if your asking for 1 mill for your stuff, you obviously wanted this to happen. You obviously didn't give a damn about your stuff.
Take it with you. The stuff you VALUE MOST should NOT be in Checked Baggage. (well... most of it.... I always made cramming the expendable games into checked, cramming games I really didn't want to replace any time soon (harddrives too) into carry on)

I had a neighbor that worked at the air lines. His home got raided and they found over 100,000 of stole electronics. He got busted because he sold something on craiglist that was stolen and the person found out it was stolen and tracked him down. I hope he wins something, I hate the freakin airlines and how they don't ever take responsibility for anything.
I also Fed ex my important stuff to my hotel when I'm going out of town for at least a week. Sometimes if its more than that I just buy another system there and carry on my games with me.

It's not that much bigger than a 360 from what I've noticed.

Well, the $1mill may also include "priceless" qualities, perhaps even punitive damages.

Who knows, perhaps he spent many hours playing various games or had custom artwork on the case which is irreplaceable for instance, the case of the gamer who had signed artwork on his X360
http://hawtymcbloggy.com/2008/02/28/another-gamer-screwed-by-microsoft/

Although the TSA are probably the culprits who did this, however, suing them is difficult and by making the airlines sweat....it adds pressure on to the TSA which could not have been applied otherwise.
I hope this guy wins...just to set a precedent.

what's the rational for excluding liability for electronics? That doesn't seem right.

Airways spokesperson stated that federal loss limit per bag is $3,300

That Airways spokesperson should read the suit and the law. The loss limit per bag doesn't apply if he can prove any type of culpability on the part of the airline... like theft.

Also, the suit states he is only claiming 1,700 on the actual loss of the console, which is below the 3.3k. Everything else is being claimed as a result of personal distress (i.e. pain and suffering), none of which is capped by that 3.3k.

Seriously... The airline companies are so inept.

Odds are, he only wanted he money that his xbox was worth plus some extra money for the saved games which he spent countless hours on. The lawyer he talked to tacked on the other part because they need to make it worth their money.

My mom was put in the hospital due to some doctor failing to prescribe some med while our normal doctor was on vacation. It cost us about $50K in hospital bills and lost wages. When my mom talked to a lawyer to get about $100K to cover the past bills and bills for reconstructive surgery, the lawyers laughed at her and told her when she was ready to sue for $10million she should talk to them. So while you think everyone is trying to make a buck, the truth is, its the greedy lawyers who need to pay off their huge school loans and mortgages.

Ok guys 25,000 for DISTRESS? let me tell you what distress is.I flew US Airways last month to tell my son goodbye as he was leaving for IRAQ. I had only a carry on bag with my camera and one for my son to take. I boarded the plane and the Flight Attendant took my bag and I said wait that is all I have and I am leaving at 6am to drivev my sons car back to Utah to keep for him until he gets back. My connecting ticket ID and everything. Well my bag was mistagged by the flight attendant and it did not arrive in Austin. I had to drive 3 days home with nothing!!! Well I got my bag back and both cameras, 62.00 and curling iron were gone as well as my connecting ticket. ALL I WANT IS MY STUFF REPLACED. I didnt get to get pics of my son before he left that is DISTRESS so what I should get 25,000! WHATEVER

I don't know how many of you will read this, but I'll give it a shot.

If you do see this, I would really appreciate some feedback. Thanks!

I had this same thing happen to me over winter break from college where my laptop was stolen from my checked bag. A $1,200 laptop with countless pictures, financial information and academic information. Everyone has blamed it on me and I do admit it was a pretty dumb move, but I was traveling with my small dog on the plane and didn't want to have to deal with one more separate thing at the security checkpoint.

Someone would have probably stolen it at the checkpoint anyways... but heres the rest:

I have a claim in with TSA for getting reimbursed for the laptop which was only a few months old. This happened back in December and we are now just making headway into the investigation just before April.

I also have a police report with the Orlando Police Department.

I have bugged US AIrways enough (around 10 phone calls, 2 letters, emails, etc) to get them to FINALLY send me some sort of form I can fill out for a claim to be reimbursed. I heard the "US Airways is not liable for electronics" over and over and over.

And I do agree with Jesse, the kid who's suing US Airways, because they do give you a very tiring run around because they don't want to deal with it.

If somehow none of these options work out for me and get me reimbursed for my laptop, I will probably be joining Jesse in this lawsuit against US Airways.

Anyways....

US Airways has subcontracted employees that, depending on the circumstances of timing, can take your baggage to a place they KNOW there are no cameras (like the cargo hold of the plane) and search your bag for whatever valuable is in it. TSA normally only has possession of your bag for the time they are doing security screening and they give it right back to these US Airways employees/subcontracted employees.

There was just an article up in Connecticut recently about 11 Delta employees who were arrested for stealing flat screen TVs, African Masks, jewelry, electronics and such from peoples bags for months.

I have spoken with a TSA employee who is a friend of the family and said that those "TSA approved locks" are jokes. Anyone can easily take a pen and jam the lock open. She told me that those "TSA approved locks" are a waste of your $15 and you're not protected against theft any more than leaving your bag unlocked.

So there's my whole rant on this situation. I feel where this kid is coming from and I would have probably started a lawsuit if I wasn't a broke college student. I know it was a dumb move on me to even ever check my laptop in my luggage, but like some of you have already commented, airports should be secure and we shouldn't have to worry about people rifling through our baggage. They can take anything out or PUT anything IN that they want. Seems too scary to be true.
