Jamie Durrant has been working for Lionhead Studios, stomping ground of Peter Molyneux and developer of the Fable franchise, for 11 years. In his time, he's worked on the Black & White series as well as both of the Fable games. As of last August though, Mr. Durrant has been out of work "sick" on half-pay, claiming sexual discrimination on the part of Microsoft. "I have been signed off sick since August with anxiety and depression," Durrant told us this morning.
The Surrey, UK resident is suing his employer, Microsoft (owner of Lionhead Studios), for £45,000/$66,000, money which will make up for "lost earnings and injury to feelings," according to the report on Telegraph.co.uk. A variety of names, laden with derogatory terms, were purportedly circulated in Durrant's tenure with the company as of late, referencing his sexual orientation: "'I'm Jim and I'm Gay," "Me and My Favourite Men," and "Ladies Are Bad," among others.
According to Durrant, when these abuses were reported to the Microsoft human resources department, the company did little to help him, apparently telling him they would circulate an email reminding employees of the company policy -- but they never followed through. When he inquired as to why it hadn't been sent a few weeks later, he was supposedly told that Microsoft would have to draft policy on the matter first. He told the Telegraph, "I was very surprised that Microsoft did not have any policies relating to this sexual orientation harassment." Less than a month ago we found out that the Microsoft Xbox Live team also have little-to-no policy written regarding sexual orientation discrimination.
When asked for more information, both Microsoft and Mr. Durrant have said they cannot comment on the still pending litigation. We'll have to wait until the London South Employment Tribunal hears his case "later this year" for more info.

what's weird is that this article on kotaku, they mentioned that the harassment started after microsoft acquired them, why would it increase as soon as microsoft bought them?

I call bullshit on this one. Mainly because there was a video on 20/20 about how there is a department head working @ Microsoft that underwent a gender change. Thing was an hour long, and the employee is still working @ MS. Not to mention 20/20 went over how HR was assisting the employee through the whole process.
I suspect in the case of Jamie, its pure BS & is bitter about something else and using his sexuality as a scape goat. Seen it done before & makes for a difficult case.

@Ex Tester
That's completely different, and doesn't reflect the same situation at all. Number one, this guy's situation involves being harassed by co-workers, specifically being mocked, and how MS basically turned a blind eye. The story you saw was about how someone at MS was being guided through their gender change with a helping hand by MS.
The first oversight you're making is to insinuate that the guy on 20/20 never gets harassed. Even if he doesn't, MS is a giant corporation, and the guy in this story probably works with completely different people, probably not even in the same building.
Second, what you saw was obviously a PR piece by MS. The cameras were on them for a very high profile show. Of course they're going to do everything they can to support the guy. If 20/20 showed up at this guy's office to do a story on him being an openly gay man working at MS, I'm sure those co-workers would be very quick to bite their tongues about any derogatory remarks, and HR would be there at every corner.
And third, the 20/20 story you saw has nothing to do with MS's lack of a proper sexual harassment policy. If the guy in that piece was being taunted and then sued, we would see what that is, but he didn't did he?
Apples and oranges my friend. All you did was say "I call bullshit because I saw another gay dude at Microsoft on TV and he was treated fine".

Agreed. Behavior like this is something you'd expect out of High School, but adults working in a team based enviroment? Ridiculous. Hopefully he wins, but guaranteed Microsoft will get this brushed under the rug and we'll probably never hear the end result.

This crap happens to me sometimes too, but I live in Missouri, where I'm guessing those antigay views are more acceptable.
Posted: Mar 24th 2009 10:38PM BananaBoat said
I'm pretty sure there are very few places on this planet where those views aren't accepted, or at least tolerated.
I also grew up in Missouri (the suburbs, to quell any "Lol, hick" comments) and I knew a couple of gay dudes in high school. They took never ending, constant crap from teachers, students, students parents, etc. TV and movies might make it seem as if homosexuals have become more accepted, but really it's more like they've become tolerated in some places, while remaining pariahs in most others.
I don't really know about the anti-discrimination laws in England, but if there is anything on the books about sexual harassment not being allowed in the workplace, then I'd say this guy has a good reason to be suing. I applaud him for asking for a reasonable amount as well, considering that in America no one sues for anything less than a quadrillion dollars. No one should have to work in that sort of environment.

You sir just got phazed by a D&D geek with action figures in his cubicle. Girls are bad...lol. That is extra tame by any measure.

Injury to feelings? No one can hurt you like that unless you let them. Not to sound insensitive but this is a little more than lame. I see people harassed all the time in the workplace sexual or not. There is rarely any exception made for him so really this guy doesn't deserve retribution more than anyone else. He shouldn't be "paid." Getting a tiny settlement won't help anyone except his wallet. What he and others should do is push for the punishment and firing of assholes who committed said harassment by any means. A little lawsuit is going to be shrugged off and nothing will change. Not to mention the guy will likely lose his job and won't be able to get another one in the industry because developers/publishers will be afraid of lawsuits from this guy. May not be legal or fun to hear but it is the truth.

In a way MS sort of facilitated the behavior. I can imagine after word got around that he went to HR the harassment got even worse. Bottom line is it's unacceptable ESPECIALLY in the work place. He should be compensated for lost wages and then a little extra coin. It's not like the guy sued on a false complaint and I would think it'd be easy for him to find work. He seems like an industry veteran and all he is doing is trying to get his lost wages back. It's not like he is some sort of liability that did this everywhere he has worked. He had been at the same studio for 11 years so I don't buy the idea that he will be blackballed out of the industry because of this incident which he was a victim.

I don't want to hold this against MS but it's been a terrible last few days for them. If the guy went to HR and nothing was done then he should be compensated for his lost wages. I guess we know where the anti-everything agenda on live comes from. ;)
They should consider rallying the base and using this as an oppourtunity to come up with a new slogan so that people of the same mindset can identify with the brand. They can have these for free:
Microsoft Xbox 360! Curing the world and your gaming itch through bigotry.
Microsoft Xbox 360! Fire them all let unemployment sort them out.
Microsoft Xbox 360! We will give you a RROD ...literally ... to the dome.

That's clearly incorrect, at least in the USA, and Microsoft is an American business, regardless of tentacles elsewhere. Your argument therefore becomes invalid. Had you steered clear of specifically proscribed discrimination, such as racial, in your examples, you might have been more persuasive.

That's not incorrect, seeing as how he's saying that's how it "should" be and not how it "is". Basically I'm saying your use of incorrect in response to him is incorrect.
Unless you're saying it's politically incorrect, which is true, and also lame. Political correctness castrates a society into being afraid to express viewpoints contrary to popular sentiment. If you believe in freedom, especially freedom of speech (which is freedom to publicly express thought, therefore it promotes freedom of thought), allowing political correctness to dominate your thoughts, words, and actions subjugates you to the will of others. If you completely agree with political correctness, you're willingly giving up essential freedoms that are easily lost and not so easily gained.

Isn't Microsoft supposed to be one of the most gay-friendly companies in the world, as far as their workplaces are concerned?
Though between this and the Xbox Live bullshit, maybe the Xbox division is an exception. (Though when I worked for Xbox customer service, one of my co-workers was a transexual. Though that was technically at an outside company hired by Microsoft. [Which is why Xbox customer support is awful, btw])

Very unexpected concerning sexual orientation and policy at Microsoft. The company is mostly well known for it's relationships with homosexual employees, but perhaps as the company has gotten bigger, in order to maintain it's appearance in front of crazy religious leaders, it has failed to continue to develop policies regarding sexual orientation?

LaughingTarget's nonsense points out something important - that despicable ideas dressed up in polished and professional language are still despicable ideas. Yea, companies should be allowed to sit back and allow (or even encourage and practice) blatant discrimination. In the name of freedom of course! The fact that we are not allowed to slur people because of their race, gender, age, or anything else, is mere proof we are on the march towards the totalitarian dictatorship.
Sorry I'll pass on this crap. I realize there are still significant numbers of people who wish to return to the days when racism and sexism was acceptable in polite society, and based on LaughingTarget's comments I will go ahead and assume he is one of them (his final sentence in his original post sounds like pathetic CYA-ing). However, I think many more are happy we moved on from those dark days.

Of course, you're right! Forcing a private individual to hire and associate with people whom he'd prefer not to is the absolute pinnacle of freedom!
Freedom of association (which is actually in the Constitution) actually means freedom to associate with whomever we tell you associate with!
Your cognitive dissonance is amazing.

You saying he "deserves the money" really? How do calculate integrity/emotion, ones feelings? It is political correctness when the first reaction of almost everyone is against MS. What happened to innocent until proven guilty? We should probably defend ALL parties involved, not just those who claim to be harassed.

Actually, there are a great many questions you are not allowed to ask AT ALL during the interview and hiring process.
Why?
Because you are hiring someone to do a job. And you should only want to know how qualified that person is to do the job, not their race, gender, religion, et cetra.
And after you hire them you are expected to treat them with dignity.
Why?
Because we live in a society that has rules that govern how we behave toward one another.
If these two points equal some sort of tyrannical government or fascist plot to undermine your business, then you're either paranoid or 76 years old and still wish that things were like they were in the olden days.

One day you'll grow up and move out of your parents house and realize what freedom should mean.
If I spend all my life's earnings starting a business, making it grow and stand to lose everything based on the success of my business, I should be able to hire whomever I please.
The government has no right to dictate how you run your business. Also, most places provide employment on an at will basis (just liket he mcdonalds you work at after school does) which means I can fire you for any reason at any time.
If someone doesn't fit the mold of the type of person I want to work for me for any reason, as a business owner I have every right not to hire them, or to fire them when they annoy me.
