So what exactly is the difference between this and the trillions of fan-art pics that go up on Da and other places? Where the common video game character is sent to die under the hands of nervous teenagers with very spread out fetishes and role play ideas?

I think seeing my favorite character making out with another of the same sex characters in that series, while wearing a dress or doing something else is far more possible to offend that series than a hard working fan made sequel. This is a sign that copyright laws need to be changed to accustom fan made developments now that it is easier than ever for any teenager to do as he / she wishes. Otherwise the creativity and etc of our generation will be held back by laws we developed a long time ago.

Great article, but I'm not getting one part: You say that if the game is bad, it could hurt the series. Now, I'm pretty sure that the only people that know about the fan-made version are fans themselves and, if the game is bad, will disregard it and wait for the true sequel. Of course, there will be a few people that stumble upon it later without knowing it to be fan-made, but their number is so small that it wouldn't have a tangible effect on the next sequel's sales.

Or am I wrong?

Let's say someone made a game about Mario raping Princess Peach, or doing something that makes him seem like a racist. It would be easy for anyone who plays video games to know this isn't a genuine game, and they would probably just laugh at it and move on.

But then imagine that some kid is playing this game and his mom sees it, is highly offended, and starts speaking out against it publicly. Now you have one or two levels of people who do not know the game is not genuine who are discussing how terrible Mario games are. And these people will never know the game wasn't the real thing, because the news about it will not reach them - it's not part of their normal news bubble.

A situation like this can hurt the brand, and that it why companies try to retain tight control over their IP.

@Marty: Yeah, you're totally right. A game involving the rape of Peach would certainly affect Nintendo's sales of further Mario games. However, I don't know many FAN-made games that do a disservice to their sampled material. Any game that portrays the original in a bad light would fail to garner the necessary attention to gain any kind of relevancy.

Then again, lil' Timmy's mom could still find it and tell her stupid friends and then Fox does a special on how Nintendo is fucking your kids. So yes, assuming the worst case scenario, anything is possible.

I'm pretty sure satire's are legal. Though if your work too closely resembles the original it may not fly.
