If "celebrities" can do this sort of thing like they do, then why not an average person? I see no fault in him pursuing this lawsuit. If all these other over paid, greedy, arrogant "stars" can do it, then so can he.

I hope he wins the case too.

What value is there in putting the image of Joe Shmoe in your picture, movie, or videogame? The appropriate damages is the value of what you could have contracted for, and not just any guy of the street could walk into EA and demand money for putting him in a videogame. Like it or not, Tom Cruise's face is more valuable than yours.

Also, if we let anybody claim right of publicity, there would be tons of suits brought for characters that accidentally or unconsciously resembled a real life person. It'd be pretty hard to make a character model that didn't look similar to any living person.

He should read the back of his ticket to see if they can use his picture on TV without his permission, I'm pretty sure it has language to do with other mediums as well.

I don't think he looks different enough to get anything for it. A lot of fans wear masks and things to the game. Besides horrible football, that's what Cleveland is known for.

I don't blame him.. why NOT try to extort 25g's from a rich super-publisher? EA has done that to their own custies in some of their games.. *cough* nfs undercover *cough*..

Ahahaha the browns suck! Why would EA go through the trouble to emphasise the teams failure by adding its hardcore fans. If anything Big Dawg should pay them for this free publicity.

Well you may not know who he is but if you've watched weekly highlight reels in the last 20 years you've probably seen him at one point or another. I've never met him but he is the probably the most recognizable symbol of the hardcore Brown's fan. And that's why EA used his likeness.

And I know he's made public appearances in the Cleveland area especially back in the 90's when Modell took his team to Baltimore.

Let's just let the courts sort it out.

Let me see if I have this right. The NFL equivelant of a cosplayer buys a cheap rubber dog mask at a Halloween shop and thinks he invented a character and now expects reimbursement for that character. He thinks that it's impossible for some other fat guy to buy the same mass produced mask off the 'net and could otherwise wear it at the same game with a different jersey number.

Sorry dude, your case is weak, especially when your creativity extends no further than the toy aisle at Wal-Mart.

Not sure what I find more revolting, his stay-puff neck or the creepy cartoon dog mask.

Either way I hope this case gets tossed out on its ass and he gets nothing. If he wins and a precedent is established, who knows what could be fair game (no pun intended).

I remember around 5 years ago people were sueing companies for finding mice fried up with their chicken mcnuggets or a finger in their chili. Now people are sueing the game industry for "character likeness". Whats next?
