Banned PSN player appeals court decision, sues Sony again for $180k

If at first you don't succeed, try, try again. Erik Estavillo made headlines in the gaming blogosphere last summer for his $55,000 lawsuit against Sony, launched in retaliation for being banned from the PlayStation Network. As predicted, the judge dismissed his case after determining the First Amendment did not apply to Estavillo's claim.

Estavallo isn't going to be stopped by a mere district judge's ruling, though. In addition to filing an appeal, Estavillo is also filing another lawsuit against Sony -- this time, a civil suit seeking $180,000 in damages; more than three times the amount of his original, dismissed suit. According to GamePolitics, Estavillo will once again opt out of using a lawyer, choosing to represent himself for both upcoming cases. We wish Estavillo the best of luck.*

Funny thing, though. I've got a friend that has a friend who's dad is a top lawyer at Sony. Wonder if he'll be involved.

More like $180,000 in lawyer costs to go against someone like Sony.

I hope the judge throws this tool in jail for contempt of court and he drops the soap in the shower.

Sony may be able to go after the guy for sanctions if he continues to file the frivolous suits against them. He's a total moron to file claims of 1st amendment violations by a private company.

I think I know why he's suing for so much more now. He's planning ahead. The "damages" that he's claiming is the mental shitstorm that he will suffer at the hands of Sony's lawyers while representing himself.

I hope Sony counter-sues his ass.

one would think right? however, he claims to have agoraphobia so he pretty much stays home...apparently, the PSN was his only way to socialize which makes total sense that he would be a complete asshole to the only "friends" he has

Clearly, increasing the damages, increases the plausibility in direct proportion.

I don't think Sony is using state appointed attornies to plead their case....and the dude has to pay court costs in order for them to hear his case.

I assume this is taking place in a court with a judge and a slew of other people that work at a court...

who pays the people that work at a court? someone is probably getting payed $30/hr to process the paperwork to go through an appeal.

See, that would make sense if these people who work in courts got paid on a case by case basis, but this is not true. They were going to get paid that amount of money anyways because they do that for a living. It's not a waste of tax-payer's money to the judge or to anyone who works there. That's like saying that people who go to school and do poorly waste tax-payer's money by going there because teacher's are getting paid by the tax-payers. Just because it's a waste of time, doesn't make it a waste of money.

True, these people get paid no matter what but they could be working in other cases which make a lot more sense that wasting time on this so it is a waste of time and a waste of taxpayer money even if it is just one minute and one dollar.

Estavillo said that he loves playing as The Joker in the latter title and may be “a bit obsessed” with the character, adding, “I plan to wear a purple suit during my court trials. No joke!”

As we discussed in July, the guy never had a case. But to represent himself? Even lawyers don't represent themselves very often. This guy deserves to be counter-sued.
