If at first you don't succeed, try, try again. Erik Estavillo made headlines in the gaming blogosphere last summer for his $55,000 lawsuit against Sony, launched in retaliation for being banned from the PlayStation Network. As predicted, the judge dismissed his case after determining the First Amendment did not apply to Estavillo's claim.
Estavallo isn't going to be stopped by a mere district judge's ruling, though. In addition to filing an appeal, Estavillo is also filing another lawsuit against Sony -- this time, a civil suit seeking $180,000 in damages; more than three times the amount of his original, dismissed suit. According to GamePolitics, Estavillo will once again opt out of using a lawyer, choosing to represent himself for both upcoming cases. We wish Estavillo the best of luck.*

dude get yourself a lawyer ,but make sure you get yourself one that love's taking on big companies .do yourself a favor & do some research, also don't be afraid to look outside your town or state. but make sure you word everything correctly & must sure you have copies of everything that lead to this issue . good luck.

This is the "me" generation at work here. Estavillo feels that he's entitled to sue Sony, and win, because his pride was broken? I hate to be the bearer of bad news but as long as the service is free Sony can do whatever they want with it. Even ban users if they violate the terms of service. Now if he paid for the service, or even spent $180,000 worth of virtual items, them maybe, just maybe, he would have a good enough reason to fight Sony on this, at least to be reimbursed for half of the amount he's put into the service. But again PSN is free and spending that much money in a short period of time is highly unlikely. This lawsuit will just fizzle like a bag of Pop Rocks and nothing more.

Even if he paid for the service, there's this thing called the End User License Agreement (EULA) that he has to read before he pays for the friggin' service. That's essentially the whole length of the contract between him and the service provider right there and failure to read that is still completely his fault.

This could kind of be a win for him - Depending where he's from, court costs could be relatively cheap and his representation is free. Sony on the other hand is paying for an attorney on their own dime which we can agree won't be very cheap, and probably only costing more and more given how the kid won't drop the lawsuit.
I think it's almost obvious that he's just going to continuously harrass Sony until they cave in and settle or offer something for him to leave them alone for the rest of his life

So for someone that suffers from Agoraphobia he seems willing to put himself in a very scary position to be willing to go to court to fight for his um free speech.

Watched a few of his youtube videos and must say it was a huge waste of time, not to mention that his voice is highly irritating which should be alone enough reason for him to loose in court. :)
