Activision applies for Drum Hero trademark

If the inside of your cranium is tickling with the distinct feeling like you have memory of a Drum Hero trademark, the confusion may have to do with the Guitar Villain and Drum Villain trademarks, that were apparently filed back in 2007 -- which is when one would think the Drum Hero trademark would have been filed as well.

Red Octane has had the drum hero trademark since GH1.
THIS IS NOTHING NEW. They are just re-registering it to prevent people from making a DJ Hero.

The legal answer: to obtain a US trademark, the registrant must show that he is currently using the mark or has the intent to use the mark within 36 months. Although the system can be abused, it is designed to prevent someone from stockpiling trademarks. Activision could not just trademark every instrument + "Hero" their developer's could brainstorm together.
