If you look up frivolous lawsuits, the US comes up every time, at least in my searches. I may be ignorant in this, but find me another country that has theme songs for law firms. It's just too easy to sue people in America, at least from everything I've seen and read.

As I said, I agree that it is easy to sue people (as in file a lawsuit), but actually winning a suit is quite difficult. Less than 10% of lawsuits go to trial, with the vast majority either settling (if there's a case) or being dismissed for lack of a good claim.

Filing a lawsuit does very little in our legal system. It starts a timer for the defendant to respond, but otherwise it's just paperwork. This guy can file lawsuits until he is blue in the face but chances are he'll never get more than a few minutes in a courtroom.

However insane some people think of Erik, well, I say good luck to him. He has nothing to lose apart from credibility online, which I dont think he cares about.

He has certainly made things more appealing in the online world of LIVE/PSN/PC hasn't he? People are talking about him, love him or hate him, he is here to stay for a while at least.

Okay, I think the guy has some... somewhat good intents... but everything about this is stupid.

No friends? Try going out every once and a while. Anywhere, really. The mall, a park, a bowling alley, an arcade (assuming one exists near you). Odds are, you're bound to find someone you can connect with.

I've never found "pain and suffering" to be a legitimate cause for a lawsuit. Primarily because people can lie about how they feel, and WILL lie for money (greed). Now, if someone was killed, a dearly loved family member... I can see that. But this? No way, José.

Video games are only harmful to someone's health if they can't tell the difference between reality and fantasy. As someone who has played video games for nearly 20 years as a hobby and a passion, they've never ruined my emotional balance, ever. You know why? Because video games are fun, not real.

I'll agree with him that it sucks being completely banned like that, resulting your system into a fancy paperweight (not that I've ever been in his seat). EULAs are a bitch like that. Companies have to try to fill every loophole to protect themselves from assholes who want to sue them for a free buck. Sure would be nice, though, if they weren't miles long and in an understandable form of English.

And to make things even better, he's living off the system. Whatever his so-called "disability" is allows him not to work while people like me do. And all of us taxpayers are supplying his lifestyle. If you're taking government money, don't go wasting it on video games, use it only for the necessities of life (food, clothing, shelter, etc.).

I agree with him that there are faults with this generation from all console manufacturers.... but I don't think a lawsuit is the right way to bring things to light (except for the faultiness of 360; I mean if there was a class-action lawsuit against PS2's DREs, why not 360's RRoDs?). Vote with your wallet, I always say. Like something and/or willing to deal with its faults? Buy it. Don't like it and/or not willing to deal with its faults? Don't buy it. Simple!

Can I sue him for wasting our time?
Part of me can somewhat understand his plight but overall he brought it upon himself for supposedly being rude, vulgar and cussing while in game. I'm sure several complaints by fellow gamers had to be filed to PSN before his ban was issued. Also his complaint about the ban making his PS3 worthless is mute because most games can be played offline. His only neagitive would be the inability to purchase DLC.

Sony, Nintendo, and Microsoft should just get together and bring the lawyers from hell down upon him.

He should really sit down and read a first year contracts law book for law school. He would learn that the judge is not in Sony's pocket, but citing what the law states about user agreements (hint: read what you agree to, especially when it is free). Of course his comments in the interview allow us to gain a great understanding of his mental level and aptitude. If this kid happens to read this, email me so you can get some of my law books to understand why our legal system is bogged down due of frivolous lawsuits such as these.

One thing that pisses me off is he is getting disabilities payments from the government says he doesn't have much, but has the money for the PS3, 360, and Wii and games for each system.

I've said before what a retard this guy is, and how he ought to have been smacked up against a brick wall at birth and everytime I read something else about him, I feel more and more that my comments are definitely justifiable...seriously though, until this lazy, money-hungry, attention seeking piece of shit actually has his day in court (wasting everyone's time and money in the process) I wish sites such as joystick would just forget he existed. Don't forget a few things mentioned between this article and the previous ones. This Erik guy is just plain wrong:

In this it says that he just didn't read the User agreement, he just clicked "I Agree"...."thats all you have to do"- OH COME ON!!!

Also, he was banned from PSN for having "Hateful" conversations in the Forums...According to this guys logic we can just hold a KKK meeting here in the joystiq comments and everyone should just respect our freedom of speech. Nope. Sorry sucker. It doesn't work that way.

I can't just run around town yelling "Hateful" things at people and expect their reaction to be "Well, thats your opinion and you're entitled to it :)" ......they'd punch me in the face and I'd applaud them for it.

Sony has some powerful lawyers, I can attest to that first hand. The hell I had to go through to get my defective SXRD HDTV exchanged....

And as for MS.. He's as good as toast.

I think they should triple his meds and put him in a nice "white room" with lotsa' pads.

If this was a serious case he'd have a lawyer... Representing yourself in such a large court manner is like walking into it with your pants down.

I am really not sure how he got the $55,000 equation though, that's quite funny...It's almost like asking for some weird dollar amount... I mean why $55,000? Why not $91,000? $103,000? or $17,000? I mean sheesh just ask for a round number... :)

Is anyone else amused by the fact that he only gets around $800 a month and yet he owns all 3 systems, a live subscription, keeps up with latest video games, and probably a WoW account? Glad he's really milking that money for what its worth.

...I guess thats the life you can lead when you live in your parents basement and are probably given everything by them.

This is what's wrong with our country. Not only does this lazy SOB get paid disability because he's depressed and has no friends, but then he can sue the crap out of anyone he wants, at no cost to him, because he's on disability. These lawsuits could cost the government millions of dollars, not to mention the cost to Sony, MS, Nintendo, etc. And that's assuming he doesn't actually win any of the suits, god forbid.

If Erik person is passionate about donating to Christian Broadcasting Network, local churches, charities, poor people on the street and giving to his god; then why doesn't he sell all of his stuff like his consoles and PC. Whatever he makes off of the sale(s) he can donate to the causes he listed. Instead of wasting government/tax payer's (Supplemental Security Income) consoles and PC to play games on. And use it for what the money was intended to be; purchase clothing, food to eat and whatever else goes to his utility bills. Instead of buying consoles, pc as well as game to go with them of course internet service. Best of all money to used to sue companies with.
