so with it being a sports game and no story to base it off of then there is no infringement? even if they bring back the "He's on fire" cheat codes with big heads and Gary Coleman then its just basically nothing that can be done about it? most interesting....

I agree that there are probably few copyrightable elements, but I imagine the copying of those elements will be pretty strong. If this game turns out to have "He's on fire," super-turbo, and other unique elements that remind us all of NBA Jam, the likelihood of it being recognized as a derivative work is pretty high.

An example of a non-derivative sequel I guess would be the entire Final Fantasy family (save for the Tactics games and XIII/XIV/Versus which apparently all take place in the same world)

Then again I guess moogles and Chocobos are derivatives.

NBA Jam was alot of fun back then . Hopefully they dont ruin the fun with adding crazy controls like with other nba and madden games . Just keep it simple so anyone can pick it up and play

I am interested in playing this game but it should be priced relatively low if it wants to make it in this market.

Graphically it looks great compared to the original arcade game years ago. I just want tighter controls, crazier dunks and loud bass action.

It has absolutely nothing to do with the original "Freeway". Although, I guess they were made the same company, so it's moot anyway.

Halloween III: Season of the Witch shouldn't be considered a derivative work, as it shares almost nothing other than the title with the previous or subsequent Halloween movies. Michael Meyers isn't involved, it's about witches, and was basically a cheap attempt to cash in on the name recognition after some producers acquired the rights to the name.
