Nintendo employs regular people so get off your high horse, That Guy. What about the smaller studios that get screwed? It doesn't matter what size you are and guess what, it was the courts that decided the judgment so if you want to blame someone, blame them. Also, Nintendo isn't going to make him pay the entire amount, I'm sure they'll settle with him.

It's always better to get fined than sent to prison. So this guy is lucky.

1.5 million dollars! Throw me a fricken bone. Soooo over the top it's not even funny.
It would be one thing if this guy was making profit off of every pirated copy that people are downloading, but to nail a guy who isn't making a profit this hard seems really ridiculous.
Someone HAD to be the first one to upload it illegally, what difference to Nintendo would it have been if someone had uploaded it one day later?
Its gonna happen no matter what, and this just seems really unfair to me.

Then again, Reggie probably don't care. That would suck coming home and Reggie is sorting through all your stuff looking for pirated games.

If they were really charging the person that was responsible wouldn't he be a little closer to Nintendo or a gaming outlet like a clerk at Gamestop. Meh I don't think this guys responsible probably just the first dumb enough to put it on a torrent/forum and make a trail to himself.

The guy distributed it before it was released so it may have been a tester or something. Sometimes they put watermarks in the game that uniquely identify who's copy it is.

OK so Bradwart reply to me saying that nintendo are not the ones making the shovelware was the post the nintendo seal of quality, despite the fact that non nintendo games can get the seal of quality and it doesn't mean now what it used to me.

Either he has no idea what the he is on about, or he thinks that every game that has the nintendo seal of quality was made by nintendo, not entirely sure which one at the moment!!

@ Danizvar - He won't he'll be delcared bankrupt or have to pay part of his salery to nintendo every month. But he actualy purchased the game so he wasn't cheap :P He was just stupid enough to upload it and brag about it

@Bradwart - I don't think its nintendo making the "shovelware" as you call it, it tends to be other companies doing that

Bradwart, you don't understand the history behind the Seal of Quality. Back in the days of yore, when dinosaurs roamed the earth, the most popular video game system was the Atari 2600/5200/etc. The Atari systems had quite a few good games, but it also had a lot of bad ones, not unlike what has happened to every lead console since. The problem was that Atari did not have any sort of quality control on 3rd party games, so many games were released that didn't even work. Consumer confidence in games went down, leading to the video game crash of 1983.

Nintendo essentially saved the industry with the NES. They included a lock-out chip that prevented the playing of games that they hadn't made sure worked. Games that passed their tests were granted the ability to bypass the lock-out chip and thus could reach market. This was the reward for getting the Seal of Quality.

Nintendo never actually used the Seal to indicate whether a game was fun or not––after all, fun isn't really something that can be objectively determined. Rather, the point of the seal was that it worked, not that it was good. If you play any of the Wii shovelware, you'll find that while the game might suck a lot, it will be (for the most part) playable. You won't find anything to the level of Big Rigs on Wii.

If it doesn't work, Nintendo tells them so, the developers attempt to fix the problem and it's resubmitted to Ninendo.

I never said Nintendo was making the shovelware, I said they were testing it. Luke interpreted my statement as 'making' when it was 'testing'. Of course it was immediately blown out of proportion.

Lighting a game on fire wouldn't count as pirating. Since it's Night Trap you're talking about, I can't imagine you mean "burning" in any other way.
