A U.S. District Court for the Central District of California has dismissed a lawsuit against Sony Corporation of America and its related gaming branches (SCEA and SOE) which alleged the company denies access to its services for people with disabilities. According to court documents, plaintiff Alexander Stern argued that his "visual processing impairments" prevent him from enjoying titles manufactured by Sony and its game divisions.
Stern had filed the suit last October, claiming Sony's practices had violated Title III of the Americans with Disabilities Act (ADA). According to Game Politics, the court stated that in order to prove a violation of Title III of the ADA a plaintiff must show: "(1) [the plaintiff] is disabled within the meaning of the ADA; (2) the defendant is a private entity that owns, leases, or operates a place of public accommodation; and (3) the plaintiff was denied public accommodations by the defendant because of [the plaintiff's] disability."
In the dismissal notice (PDF), the court ruled that because Sony is not a "place of public accommodation" it was "not liable" for violating Title III of the Americans with Disabilities Act.

I'm disabled myself, and I completely agree with this decision. This guy obviously didn't have any problem finding a lawyer slimy enough to go along with this.
As I said before, sony isn't the one who manufactured this guy's television, nor did they install it for him. There is literally no way sony could be responsible for this guy's inability to adequately see his games when the plaintiff is using equipment of his own choosing to play them on.
Shut up and go buy a new TV already... you're making the rest of us gimps look bad.

been there, done that. Arizona State, Pace, Case Western, and Reed College all got sued for using Kindle based textbooks because while the Kindle has a text-to-speech function, the menus do not, thereby making them impossible for blind students to use. google for "kindle blind" if want more info on the cases.

I'm surprised (well not totally) that the case even made it this far. Even I could figure out the ADA does not apply in this case, and I'm not even a lawyer. Well regardless, there should be an easy fix to these type of situations.

where i work we have a *BLIND* supervisor... WTF? How the hell can you SUPERVISE if you're blind. Nothing wrong with being blind, but FFS, the guy makes some really stupid decisions because he overcompensates for his disability.
