Following the departures of two Infinity Ward executives, a related story has gained significant traction and deserves some attention. BingeGamer reports that the development studio "has yet to be paid a single dime in royalties for Modern Warfare 2," ostensibly to be paid by publisher Activision. As Infinity Ward is a wholly-owned Activision studio, we turned to some leading industry analysts to explain what appears to be a private contractual matter.
EEDAR analyst Jesse Divnich tells Joystiq, "I couldn't speak to what the royalty agreement between Activision and Infinity Ward is. If royalties haven't been paid out yet, I wouldn't consider that too alarming. The game has only been out for a little over 90 days. Additionally, it is common to see royalty agreements based upon factors such as hitting release date, review scores (a.k.a. 'Metacritic Clauses') or revenue milestones. I think if you just replace the word 'royalties' with 'bonus' it should make some more sense."
Wedbush Morgan's Michael Pachter explains, "I don't know the nature of [Infinity Ward's] contract, but my bonus is paid after year-end (in February), and theirs is likely the same. The idea that they haven't been paid 'yet' is not all that surprising. The year just closed, and the final SEC documents were filed yesterday." He continues, "IW sold itself to Activision back in 2004, Activision owns the [Call of Duty] IP, and the guys leaving were employees under some kind of contract. Activision appears to believe that they have breached this contract, and may or may not be justified in withholding bonuses."

"It is common for publishers to reward developers with bonuses or royalties. Typically, a publisher will pay upfront for a game's development cost (especially when they own the studio), but they draw up agreements to incentivize the developers by paying out royalties. Usually royalties are not paid out until the publisher recoups all development costs. I've seen royalty agreements as low as 1 percent to as high as 20 percent. I couldn't speak to what the royalty agreement between Activision and Infinity Ward is. If royalties haven't been paid out yet, I wouldn't consider that too alarming. The game has only been out for a little over 90 days.

That's bullsh1t. Game makes you a billion dollars, you better pay out some damn royalties. I'm pretty sure they broke any 'revenue milestone' Kotick could have dreamed up.
And Kotaku is reporting that Kodick is speaking to the remnants of Infinity Ward at 1PM Pacific time. Bet that'll go well (read: employee walkout)

Excellent explanation by Pachter and Divnich. It's too bad that what would be an internal HR matter at any other company gets blown up across the internet just because these guys happen to make games.

b) Their departures were because of "insubordination" a term which means that all is not well between the management at Activision and their studios.
c) Games like the other entertainment industries is highly dependent on good talent creatively and technically. It is not like large corporations like Walmart or Kraft where a suitable substitute can be just put in and all will be well.
d) Its a well known fact that Kotick is a douche and I hope his vision of a sequel only nonsense comes to an end soon.
Ok the last point was very personal but I still believe this story is important and could well affect the MW brand.

Did you even read the post? All those guys just said that it's not surprising at all that they havent been paid YET because royalty payments work just like bonuses; ie you don't get them till the year ends....
I hate activision as much as the next guy but stop the blind activision bashing and actually READ.

Blight, he's not wrong about the status of IW's ownership, nor is he wrong about bonus payouts. I'm not at all surprised that Activision isn't paying bonuses yet for MW2 no matter how many copies it sold. Also, would you pay out bonuses if there was a chance that the people you were going to pay them to violated the terms of your agreement? Get a grip.

I just got some interesting news from a game developer friend. Security from Activision has invaded IW and is standing around bouncer style at exits, claiming to be investigating 'insubordination'.

This is going to give Activision a whole lot of trouble... or as he says, "heaps of shit-ass trouble." The developers community is vindictive, and Activision is NOT making friends doing this. A lot of their developers will start going and knocking on other doors, like has happened in the past with EA... and EA had to close studios. Thing is, Activision is notorious for muscling people out, so it was kind of expected that something was going to be off, but this is way more than anyone imagined.

I'm hearing insubordination and they probably freaked out over unpaid bonuses like mentioned above, wouldn't listen to anybody concerning their contract and decide to act out in anger and they got fired.
So based on the original insubordination claim, why are they heroes again? Why should Activision be the bad guys in all of this if that's the case? We reward bad behavior now wtf?

Activision should know why IW was created in the first place. I liked it better when developers and publishers were seperate. And when publishers actually had to work to get deals with the developers. Now all they do is gain/buy the IP, whore the franchise, and get other devs to half-ass their games.
Seperate the developers from the publishers and we won't have these problems. Bobby Kottick didn't do anything to deserve a single penny from any of the franchises they own.

Yeah, maybe one of those was to follow Treyarch's lead and announce DLC in Feb (like Treyarch did) and release it in March (like Treyarch did).

You never know, maybe those IW executives saw all that loot and decided to try and break off to go on their own, taking some employees with them- maybe someone at Activision got wind of it and brought down the hammer.

WOW! If the secret meetings point is true, that is absolutely grounds for immediate termination. Activision would be well within their rights to can them. Best to wait to see if this information is confirmed by other sources, but damn. That's just asking for it.

If I where to speculate, and I guess that is what forums like this are for I would guess that the issue is more that these two guys where looking at their contracts expiring in October and had started to plan for that. While they could have stayed on, I wouldn't be surprised if they had started looking into leaving and setting up a new studio. Activision probably found out about it and was none to happy, and thus the current situation, especially if they had been talking with other publishers or had been trying to get some of the IW staff to come with them.
