Some actually still care. If the IW heads got fired so Acti wouldn't have to pay bonuses, this is huge to the video game industry.

You're a dumbass. What they're doing is exposing corrupt business practices, and all you do is say you don't care? The more corrupt they get, the lazier these devs will get, the poorer the end product is going to be. I'm pretty sure that you SHOULD care.

I think West/Zampella are entitled to tens of millions in royalties, plus punitive damages, but I agree completely with Pachter.

The Memorandum of Understanding says that West/Zampella get to call the shots for another year on the Modern Warfare 2 franchise, and Activision violated the MOU.

So what is the recourse for the execs? In this type of situation, it is almost always financial damages. Activision will not permanently lose all of their IP rights, when the agreement simply stated that West/Zampella would only have limited IP rights for another year anyway.

Even if Pachter does own some Activision stock, it shouldn't matter. The SEC regulations on analysts trading in stocks or sectors they cover are pretty restrictive and prevent Pachter from participating in whatever conspiracy theory you're working on in that brain of yours.

Also given his high ranking position at Wedbush, it's not in his interest to manipulate the stocks he covers.

Yeah, I'm pretty sure this is a deal. Maybe not a big one, but a deal nonetheless.

Personally, I'm curious as to what happens. When a game makes a splillion dollars, I think it's worth keeping tabs on the studio.

Huh, i had assumed that something was up relating to that Memorandum of Understanding regarding all of this, that Activision had only "pledged" to give Infinity Ward any kind of real, ultimate control over the fate of Modern Warfare as a goodwill gesture, and not as anything especially legally binding

My bet is that that indeed is the case, that the Memorandum was just a letter of intent, and not enforceable as contract. I have a hard time envisioning Activision giving a wholly-owned developer any sort of real legal control that would allow them to cleanly defy them.

Sometimes I question why such things exist if they're not worth the paper they're printed on. Seems more and more it's so big guys can screw little guys who don't realize it isn't binding.

I agree. And I'm sure that memorandum of understanding will be very 'creatively' interpreted by Activision to make sure it doesn't hold any water.

Then again, the IW bosses would have to be total idiots not to have foreseen this when they agreed to this memorandum. Personally, I would have had lawyers read this for a whole month before agreeing to anything that wasn't a LEGAL BINDING CONTRACT.

Man, does anyone even care about Patcher's opinion anymore? Oh wow, you predicted Activision doesn't want to lose its most profitable franchise! Amazing job there guy!

I mean, did anyone actually think these guys were going to win the Modern Warfare brand name in the first place? That part of the suit was always a huge stretch.

I think a lot of us do still care. To be honest if Activision were to lose this suit I think I could go without their products all together. To be honest I find this fasinating cause for the longest time people have hated Activision and accused them of being overly greedy. If this suit goes forward a lot of dirt will be brought out about Activision and we may finally see thier true colors.

This is relevant to all of us as gamers. The outcome of this trial doesn't matter half as much as the information that comes out of it. If Activision were to win this Trial but piss off enough of the Modern Warfare fanbase in the process it could kripple the sales of future modern warefare games. Regardless as to who wins this trust me I'm going to be keeping an eye on whatever new project the IW developers go to next (keep in mind that though the 2 heads got fired when they start a new project they will most likely recruite the best of the development force currently at IW). Activition wants the Name 'Modern Warefare' but they could actually get the name and loose the fanbase. This is huge!

I feel like West and Zampella are going to lose out here. It's not because I don't think they should get the royalties, but Activision is just so big and powerful and is gonna have a ton of high-powered lawyers at their back, I just don't see justice being served. It's like Jason and Goliath. But hey, here's hoping they still succeed.

why are you citing this guy as some sort of legal authority...I could give you a better legal analysis than this...of course the case will largely depend on the wording of the MOU. I don't see any relevant analysis here. This guy should be taking notes on the complaint(written by some of the best lawyers in the world) not critiquing it.

Even if this Memorandum of Understanding states that IW has control over the Modern Warefare brand... IW is and always will be owned by Activision. The booted execs could win, the IP be given to IW (not Jason West and Vince Zampella) and Activision still have control over it as Jason and Vince will not get (or want) their jobs back.

As this post states, we are only seeing one side of the story. The other side could be that West and Zampella was orchestrating another bail, taking the MW name with them to form their new company. Activision got wind of the deal and promptly sacked the two.

From the Memorandum, it appears that West and Vince can produce another MW game but Activision will still own the IP.

I am sure this is not a case of paying the execs their bonus since that is chump change compared to the amount of money made off of MW2. This is about ownership of the IP which is a much bigger deal.

I feel that West and Vince will get their money since that is not really a big deal. They can forget about getting the COW or MW IP. IW is owned by Activision and if you think Activision is silly enough to give those two the IP to a billion dollar franchise then this is definitely not the same Activision I know.

West and Vince better hope there isn't any evidence of them leaving Activision and forming their own company. Activision could easily have a few delves come out and say they were approached or even have email from the two talking about such things. People always forget that email is always monitored until they get hit in the balls on such things.

Prediction: Lawsuit settles out of court for an undisclosed amount. West and Zampella move on to something better. Modern Warfare becomes the next Guitar Hero franchise and Activision continues to print money with other franchises.

Activision or IW have already shot themselves in the foot for MW and PC gamers by not offering the opportunity for dedicated servers.
What I'm more concerned about is the ramifications on the other studios that Activision has bought into the fold, particularly Blizzard. It seems like Activision give Blizzard a bit of leeway with their product and development targets, but really hammer hard on the other studios/franchises, like Guitar Hero and CoD.
More and more, it seems that Activisions obligation for good product that isnt crippled stops when you hand over the money at the counter. MW2 is a good single player game, but it's definitely got a limited life span (which is probably what they want, if they're going to spew out more product in the franchise).

In a way, it's not too difficult to see Activision's business objective over the past few years:
1) Agree to publish a low-budget developer's game.
2) When it succeeds, buy the developer with a bogus contract.
3) Take over the whole operation
4) Milk the franchise until it dies
5) Get rid of the original developer before they charge Activision the bill.
6) Move on to the next poor developer.

Can someone please just answer this question:

Who is right?

To me it seems like Activision - these two were out to get a fast buck and the company stood up for its shareholders and prevented them doing so.
