Here's a solution Nintendo.

Just make a pokemon mmo and STOP GETTING PEOPLE HOPES UP with a CND thrown in.

You're kidding right? The reason we got into making an MMO is that Nintendo's Online Service is horrible and mediocre.

Their idea of an MMO would limit players to up to 3 predetermined phrases (If any!), you'd have to select your username from a list of pre-approved usernames, and would require inputting 64 digit hex codes to enable trading and battling with someone.

Yea, that would really suck. I'm in the Lego Universe beta and although it doesn't use pre-approved phrases, all the words you use have to be in their dictionary, so you can't use slang or misspell anything. Not to mention they are overly careful. Example: There's a location in the game called "Pet Rock" that I was trying to ask some one how to find but apparently "pet" is considered an inappropriate word .
I also couldn't make my username "SpeeGold" cause it had the word "pee" in it. -_-

I don't seem to get why they'd shut down a fan game or MMO that doesn't require paying. People will still buy the games to have them on the go so how are they a threat? Donations?

It's the way copyright law works. It's unfortunate, but copyright holders must protect their IP, otherwise that IP becomes public domain.

Wow that statement is so factually incorrect it makes me hurt. You seem to be confusing trademark and copyright. If a trademark becomes generic you risk losing the trademark, but there is nothing in our copyright law that says you lose it if you let other people create characters/games/whatever based off of your copyrights.

Yeah but Pokemon is under trademark laws, not copyright. Thus why they have to C&D. Most games are under Trademark laws.

Apologies for using the wrong word. As with most comments on blogs I dashed it off quickly, not realizing it might make some uptight jackass "hurt." Pokemon and the associated characters, etc ARE trademarked however, so my point still stands in regards to Nintendo's C&D here.

And really dude, if someone using the wrong word in a blog comment makes you hurt, it's time to step away from the keyboard.

Pokémon isn't a trademark (™), but a registered trademark (®). So, they got some legal stuff behind it.

Like it or not (I don't), they are well within their rights to close down any fan projects.

This is more valid than the Kings Quest C&D, Pokemon is still a massive franchise, not a dead one and it's not that the game is making money from the name, more that it could be damaging if it was guff.

Still, bit of a Dick Move, but compared to kotickvision, it's not that bad.

But they really just don't want to do that I believe. Make a Pokemon MMO, that is. I believe one of the guys at Game Freak or Nintendo said that there's a reason one doesn't exist already.

Which is the real dick move to be honest.

I disagree on the dick move thing. People could totally just get their pokemon fix by playing this, seeing is how this just openly takes the entire firered/leafgreen game and ported it over to the PC. The sprites, design, names, everything. It would be different I think if they would have just used the pokemon characters in their own created world, but they full on stole every bit of pokemon FR/LG to make this.

In this case, Nintendo was justified and this wasn't a "dick move" the way and Square Enix have done. Pokemon is pretty much their second most active franchise and the trademark needs to be protected.

However, this whole fiasco PROVES there's a market for a Pokemon MMO. If not for the next Nintendo Console (WiiHD?) or 3DS, it should be for PC or browser-based.

I wonder, if these devs changed it to Digimon MMO, if it would be OK then.

It, and like a lot of the other poke MMOs, weren't that great. I've played a few of them. Either laggy as hell, or god awful communities. The amount of "P3n0r"[changed due to JoyStiqs censorship] named pokemon was outstanding. Like, I expected maybe to encounter a total of like 10 trainers, but no, it was above that. WAY above that.

Game Freak has a relatively narrow vision of what the core Pokemon experience is, though i imagine if The Pokemon Company (separate entity that manages Pokemon overall) agitated enough for an MMO, Nintendo would find someone willing to do it, the problem is that would probably occur against Tajiri's wishes

While I believe Nintendo is more than justified in submitting the C&D, I'm still upset that they haven't started a project like this themselves. Like a true console-RPG version of the franchise, this has been something fans have been calling for for ages.

Nintendo, I'd be more than ok with paying a fair monthly fee to play this and I'm sure there are several million more out there who would.

Why don't these people put their talent and effort toward... I dunno, their own ideas? This is going to happen every single time. If they don't want to get squashed, why not come up with something that the big-named company's won't eventually shut you down for?

Because original ideas are actually a lot harder to bring to fruition. A lot harder to find people to come on board with a community project and most of all, it's very difficult to establish a decent grounding for your storyline, artwork and just about everything.

Fan communities take the small-Japanese-3rd-party-software-development model to heart. You have companies like Dimps (who made Sonic Advance, Sonic Rush and now Sonic 4) who haven't put out a single original game, ever. But they do push out big name brands like Sonic, Dragonball and hell, co-developed Street Fighter IV. It's low-risk, high-reward. Think of it as movie-tie-in-games for Japan... Only good.

I'm sure Dimps, with that kind of pedigree could dish out some absolutely amazing AAA titles of their own. But why chance a couple hundred million yen investment into a new IP which you have to build up brand recognition when you can buy into a pre-existing brand and reap the benefits. Same applies to fan communities. You get the attention of pre-established fans for both developers and users. And at the end of the day, open-source projects are out their to get attention, it's their pay-off, if you will. So I believe that comparison is quite valid.

Simply put, they have a passion for the game, and a lot of people can respect that.

It's not so much them wasting their time...to them, it's not wasting time. It's just a fun little hobby for them. A hobby stemmed from playing that popular game and growing up with it.

It would be nice if Nintendo wanted to maybe put in money to hire them on...maybe make the MMO with them on the team. Eh, either way, Nintendo was still in the right for the Cease and Desist.

I don't think they monitor the domains containing "poke".
Case in point, In Red & Blue days almost got suspended my freshman year during computer class because Yahoo searches for "Pokemon" yielded "Poke-a-MAN" in the results.

I don't use Yahoo anymore, but I assume that they haven't fixed that problem.

I understand the shutdown of the development of the game and assets infringing on their IP, but can they really seize the pokedev.org domain? I mean, there's tons of fan sites out there with domain names that have parts, if not the whole, game name in them. I understand everything but that move, seems a little overkill if you ask me.
