I'm with the cowboy on this one.

If someone could just take all these legal documents, letters, filings, and all that mumbo jumbo... and just make a "for dummies" version of it, it'd be greatly appreciated.

I know it's mostly easy to follow along by just reading the article, but that doesn't always go into as much detail as the documents themselves do.

Now we get to hear Activision's side of the story, and Activision just ends up looking worse in this mess. Here are their core complaints:

1) West and Zampella, junior execs, had a private negotiation with another company about moving to a more lucrative position in the future. This happens at least ten times a day in corporate America.

2) West and Zampella were difficult to work with while they were delivering a billion dollar game, on time, for Activision. This is the problem every software publisher in the world would like to have.

3) West and Zampella were so rude, they wouldn't sign a bunch of documents saying they wouldn't talk bad about Activision when Activision was firing them and witholding $30 million in bonuses.

4) West and Zampella were awful, awful employees who committed acts that deserved immediate termination. Except Activision didn't terminate them. Because they were really, really good at their jobs, and they were delivering a billion-dollar software title, on time, for Activision.

So Activision let them do their really, really good job, on time, and pocketed the billion dollars. And now they want the judge to understand that they were so f*cking awful at their jobs, that they should lose their $30 million dollar bonuses and they should retroactively give up their pay and benefits during the time they were so very, very awful by being incredibly amazing at their jobs.

I don't see how it makes Activision look worse at all.

It's simple, your train of thought is just like what Zampella and West seemed to have. It's the "We are going to make a ton of money for you so you have to put up with our shit" mentality. It sounds like Activision called them on it and told them to GTFO.

Sure Blight, but the people that they are pissing off would probably be getting the same salary even if CoD didn't exist since it is a public company. Plus, Activision makes plenty of money through other games. Let's say that Zampella and West really were turning the IW team against Activision. If they let that continue, stuff could blow up big time and the whole IW team could leave. Financially, that is much worse then just cutting off the source of the problem.

Did you read Activisions 2009 financials? They only made a profit of 113 odd million. That means if it weren't for MW2 the company would have reported a pretty good loss.

Exactly. They could have never released that billion dollar title, the highest-grossing game of last year, and Activision would have made exactly the same amount of money.

All the execs would have been bathing in the profits of Guitar Hero: Van Halen. And Tony Hawk: Ride. And DJ Hero.

Let's put it this way.

Activision made over one billion dollars from MW2 by the end of the 09 fiscal year. However, for the fourth quarter they posted a loss of 268 million dollars. The whole year only made them 113 million dollars.

Let's subtract 1 billion from 113 million. That's 887 million in the hole. Now, add back the 200 million they spent marketing the game, so we're at 687 million. And we'll be generous and say 40 million for the game's development. That's 647 million. Now, obviously the development costs weren't all in the fourth quarter, but not having MW2 would have resulted in Activision posting a 248 million dollar loss for the year. So yeah, they needed these guys.

Thats how it works in the business when you get fired, you sign papers that say you wont talk about things inside the company, or share code. Its how things work in any highly competitive market. I bet Apple does the exact same thing with the people they fire.

I do think that if they did what Activision said they did above, then they should have gotten fired.

All of this is aside the point. There were contracts signed. If West and Zampella violated them, they're in the wrong, and that's the long and short of it. And remember that they were making this money for a company that gave them the majority of their start-up money in the first place

Maybe it would be better if they dealt with this "insubordination" as is done in the military portrayed in Modern Warfare 2. Make them do 20 push-ups and make them job 15 miles in the rain and mud.

It would be necessary to see the original contracts, though, to understand whether this has merit or not

Though i think it's easier to see that West and Zampella are not entirely innocent in this, but Activision's lawyers' language in this really doesn't make them sound like they're in the right...
