"Since being fired by Activision, Jason and Vince have taken steps to regain control over their creative future and plan to have an announcement very soon," Robert M. Schwartz, attorney for ousted Infinity Ward studio heads Jason West and Vince Zampella, told IGN.
Responding to the claims made by Activision in the countersuit filed today, Schwartz described Activision's statements as "false and outrageous" and argued that, while West and Zampella did in fact hire a Hollywood agency to represent them and consider spinning off the studio, both of those actions were driven by Activision. Their rationale for hiring the Creative Artists Agency was only to "advise them in their negotiations with Activision, and not to breach their contract," and it was Activision itself who came up with the original spinoff plans for the studio, Schwartz said.
Even if the claims were true, says the attorney, West and Zampella's actions haven't "had any negative affect on Activision -- none," before pointing out that "Modern Warfare 2 has been the world's most successful video game." Schwartz says that West and Zampella "would still be at Infinity Ward developing new games" if Activision hadn't "kicked them out."
With plans to announce something "very soon" relating to their "creative future," we expect them to be back to developing new games. Just not at Activision, of course. And under an umbrella of legal intrigue.

The allegations Activision made today are false and outrageous. Just one example is Activision's allegation that Jason and Vince conspired to spin off Infinity Ward. Activision itself proposed spinning off Infinity Ward when, last year, it sought to renegotiate Jason and Vince's contract to induce them to forego developing a new game in favor of doing another Modern Warfare sequel. Jason and Vince had hired the Creative Artists Agency to advise them in their negotiations with Activision, not to breach their contract. The conversations with IW employees, talent agents, and others during these negotiations with Activision were conducted to see if Activision's proposal could work, and not in disrespect of their obligations to Activision.
Activision's inaccurate and misguided allegations lose sight of the reality here: None of the false claims of insubordination or breach of duties had any negative affect on Activision -- none. Modern Warfare 2 has been the world's most successful video game. And none of this changes the fact that Jason and Vince would still be at Infinity Ward developing new games except that Activision kicked them out. This is just an Activision tactic to avoid paying Jason and Vince and everyone else at Infinity Ward the millions of dollars they all earned and that Activision owes them. LOL I don't think many of you guys know hat the leads of Infinity Ward actually worked for EA before leaving them (worked on original Medal of Honor). EA imposed too much creative limitations (back then) so the thought it was best to form their own studio. The irony!

but seriously, reading activisions counter suit made them seem pretty insane.
i mean, it's as if they literally wanted them to be zombies for the company (yes, i know it's activision we are talking about, but to actually expect that is pretty scary), i mean, wtf is wrong with activision, it's once thing to be hated by the gaming community for certain things, but it seems like they are taking a direct interest in ruining their representation.

Welcome to American Business 2010.
Doing insane moves for profit motive and without regard to employees is part of the business world.
This will only hurt Activision in the long and probably will get Kotick gone sooner. Other than reviews that Call of Duty: Modern Warfare 3 and Guitar Hero 6 will suck or won't sell as well as past games.

I called it when this happen and I still believe is going to happen to Blizzard. Kotick is going to use some loophole in a contract to gain control of Blizzard. Its going to happen. Its just a matter of when. He already planted the seed when they changed management in Blizzard. Its only a matter of time. I just hope Diablo 3 comes out before that happens......

Kodik is not a games player, he has probably never picked up a games controller he is a hole that only understands money.. I have worked in IT for a while and have worked under ass ceo's like him, they have no understanding of technology of the industry they are in all they understand is greed. They make life hell for employees sack too many and earn the most ridiculous salaries and even more ridiculous bonuses. Their greed knows no bounds and his greed will ultimately be his own down fall..
How many currently hate activision ? Lets face it he has already begun tarnishing the company name. Their greed has been showing for a while.. $15 for a map pack ? really ? its called the height of greed. Increasing MW2 to £55 in the UK again it just demonstrates their greed.
I have made it a point to not buy games published by Activision. I Dont think I will be the only one, I doubt any next iteration of games they sell will have the sort of market share MW2 had..
The allegations raised by Activision against the developers shows clearly that all blame lies on them.. Take Kodik back a few hundred years and I can picture him being heavily involved in the slave trade..

I'm in a daily position to recommend product and I steer people away from Activision's products - tell them to get Split Second over Blur, won't promote or recommend Singularity, recommend Rock Band over Guitar Hero etc.
Screw them. Let people hear about how they milk properties and how watered down they've become and watch how people decide with their wallet like I have.
