Exactly, Ryan. Its had been months since MW2 was released and sold a trillion dollars. Plenty of time to declare MW2 a sucess and start handing out bonuses. Every time one of these Activision spokesdroids talk it just makes them look more guilty.

See, this is what I don't get.

Activision has yet to pay a single employee at Infinity Ward, one red cent of bonus money for Modern Warfare 2.

Yet, they keep promising any employee who remains with the company, a cut of Zampella's and West's share of the royalty check.

Does anyone see something inherently untrustworthy with this action?

I mean think about it. Activision has not paid a single one of the remaining employees the royalty checks Activision already owes them and has owed them for months. Yet now they are promising the same unpaid employees, that they will pay them someone else's royalty check.

ZOMGWTFBBQROTFLMFAO (maybe that's a bit over the top)

Anyone still at Infinity Ward hoping to get a piece of Zampella's and West's royalty checks, you can stop holding your breath. These guys have not even paid you your own royalty checks yet, what really makes you think they are going to pay you someone else's?

And that is of course, IF they can win a court trial against Zampella and West . . . a case that could be held up for years in court. What? You guys gonna wait around for years, taking Activision's abuse, just trying to get a nut?

I know crackheads who tell you the same thing if you loaned them some money, "I can't pay back the money I owe you, but if you help me score some more money for this other dude, I'll pay you some of that."

Dan was great with OXM. The podcast rocked. Since leaving for Activision, the OXM podcast is now Ryan McCaffrey and Andy Baumann from... I think a PC magazine?

I kinda feel bad for Dan. He took the job knowing that he'd have to make Activision look good - already a difficult task - then the thing with Infinity Ward happened. He was put in position to fail - Kotick is making Amrich's job tougher with every day that passes.

Maybe it should be FU to West and Zampella for demanding the share of the bonus for themselves and not giving Activision a list, as they requested, of the other 100 or so IW employees that should get bonuses.

Everyone is quick to jump all over Activision, but I would recommend reading both lawsuits entirely through. I think both parties a share a little fault here, but don't blame Activision fully. If what is claimed in the lawsuits it true, West & Zampella were up to some shady things in my opinion.

Because people seem to sympathize with Zampella and West because they are two lowly employees that can't do wrong against the evil empire of Activision.

How am I defending Activision? Who am I to argue who is right and who is wrong. I don't have the facts for either side, all I have is info that Activision and Zampella/West lawyers tell me and we all know how that goes.

All I am doing is asking questions instead of jumping on the Zampella/West bandwagon. Would you rather me be a sheep and say "Yeah! Activision should stop making all these false claims!!" when I have no idea what false claims that they have made in the past? Take a look at this thread, most of my comments are voted down not because I'm siding with Activision but because I'm trying to be fair.

Here's why, at least based on what I can see, is why I would believe West and Zampalla over Activision:

If Activision was on the up and up - why all the departures of veteran developers from IW, especially when bonuses are still due? People do not up and quit their jobs - especially in this economy - if they don't have a high degree of dissatisfaction with their work situation.

As with ALL things in dispute - look at who benefited. Who gained more with the split? West/Zampalla or Activision? From what I see Activision clearly benefited from West/Zampalla no longer being at IW as they could attempt to maintain control of a billion dollar franchise and withhold millions in bonus $ - and as for 'distributing' West/Zampalla's bonus to the remaining members there is no way for those employees to know what that arrangement was $wise.

Lastly, Activision - specifically Kotick - has flat out said they want to exploit franchises and create a negative work environment. They have let go and sued several previous creative partners in the past and the IW situation is reflective of a pattern of behaviour from Activision.

I'm a rational, even minded guy and before this I made a decision to no longer support Activision with my dollars because I don't like their business practices or CEO - the IW debacle merely cemented it. We'll see more as things develop but I see no reason to believe this was nothing for than a greedy cash grab for a greedy company that has no regard for their customers or creative partners.

I agree - we don't have all the facts, and I'm also not going to apologize for what West and Zampella did. Talking to EA was clearly out of line.

Activision had every right to fire them after that. What they DID, though, was keep them around until the launch of their product, then fire them before paying the bonuses. Essentially, Activision wanted to have it both ways, but if you are going to keep someone on a project, you have to pay them. If Activision paid them then fired them, I would consider this rather neutral.

What Activision did is extremely exploitative and wrong. I don't NEED any other facts to decide who I'm siding with - what they did should scare all developers, everywhere, because it sets a precedent, one that says "Make the best game ever and you might not even get paid!" This is wrong, and this will destroy the drive of devs to create excellent games.

First, Dan didn't "sell out" for anything. He doesn't get the big bucks and everything he said was mere conjecture. Joystiq should have never reported his comments as official statements. He doesn't know anything more than anyone else - he's just giving Activision the benefit of the doubt. You don't know what happened between Activision and IW. Yes, Bobby Kotick is seemingly evil, and yes, West and Zampella made a great game. But we, as outsiders, can't base everything on these two judgments alone. For all we know, the IW execs broke their contract. I don't think that's the case, but we can't be sure.

Second, Dan's a stand up guy. He was just trying to discuss Activision with disgruntled fans in a way that we can all appreciate. He was a great writer at OXM, he's always been completely honest and open on his blog and everywhere else, and you guys are giving him crap for talking directly with fans and positing that maybe, MAYBE, Activision was in the right (something about which we can't possibly be sure). God people, where's your decency?

You know i never expected the "Activision" logo to keep me from enjoying a truelly fun game, but i went to try the demo for Blur hearing it was like Mario Kart on crack (i can dig it!) and as soon as the Activision swurled up on the screen i felt myself die a little inside.

Word of advice to any would be developers in search of a publisher, go with Activision and automatically a sell out. Sorry to say it cause there are great developers at Activision but with a face like Kotick's popping into my head every time i see they're logo it makes me want to bust my system apart with a stick.

Anyway, those remaining at IW...take the bonus, then leave for Respawn (I know Activision lawyers have probably protected themselves against this, but if they haven't, do it!).

Anything an employee creates at his job belongs to the company. So yeah, even though you know the secrets, you are contractually obliged to keep them to yourself. In that case, you can steal secrets because you don't own them.

Ok, I'll explain this to everybody that is unaware of how this works in the tech industry. I'm a programmer. Whatever I program at work, my company owns it. If I am suppose to be programming backup software but I get bored and program a fart app for the iPhone, my company owns that fart app. It's part of my contract and is common practice. If I go and sell that fart app or share it with someone else, I violated my contract because I am sharing/selling goods that I do not own. That is stealing by definition. I stole a product that I produced but is owned by the company I work for.
