Rather than the usual news of Infinity Ward staffers leaving the company, occasionally jumping on board ex-IW founders Vince Zampella and Jason West's new development team at Respawn Entertainment, today we have word that a group of current and former IW employees are suing Activision for breach of contract. G4 got its hands on a lawsuit filed in the Los Angeles Superior Court by 38 plaintiffs -- a band of folks named the "Infinity Ward Employee Group" -- seeking "to recover between $75 million and $125 million, if not more, in compensatory damages." The group is also asking for another $75 to $500 million in "punitive damages."
Allegedly, the employees of IW have received $28 million in bonuses, and are claiming to be owed another $54 million from just 2009. The rest of the treasure chest is sought for a gaggle of other reasons, ranging from "lost value on restricted stock units that Activision promised would vest" to MW2's "sister games," which seems to include the still-unannounced Modern Warfare 3.
In fact, the group's lawyer Bruce Isaacs contends that, in holding the remaining employees based on claims of larger royalties, Activision has breached those employees' contracts. "Activision has withheld most of the money to force many of my people to stay, some against their will, so that they would finish the delivery of Modern Warfare 3. That is not what they wanted to do, many of them. My clients are entitled to their money. Activision has no right to withhold their money -- our money." The suit's legalese also claims as much, even going as far as to accuse the publisher of holding "[IW] employees hostage so that Activision could reap the benefit of the completion of Modern Warfare 3." Yikes!
Update: Activision has responded to the lawsuit with this statement: "Activision believes the action is without merit. Activision retains the discretion to determine the amount and the schedule of bonus payments for MW2 and has acted consistent with its rights and the law at all times. We look forward to getting judicial confirmation that our position is right."

That's disappointing.
They should have sued for an Infinite dollar amount.

How deep's that bench now, Bobby?
Kinda sad moment though, this is movie/music industry type drama, the video game world has largely been spared this kind of money spat because it was kind of a niche industry...
But now games are big bucks, so I expect we'll see more of this kind of thing, and more games pushed out that have that 'dumb blockbuster' kind of appeal. But hell, what do I know? *plays Star Control 2 on PC*

If Kotick has 1/4 the charisma and leadership ability that I have he would not be in this position. I could get Infinity Ward to pump out whatever I want without complaint using my RDF.

Nice try. Really. It's funny. But Steve Jobs does not care one lick about video games. He has said as much. And they don't support any of the hardware companies that would make playing games easy/er on there macs. That's why games on the mac suck no support form apple.
But, I laughed so that's all that matters. =)
Also, and I know this is just my opinion and it really isn't the same as most peoples, but I never liked the CoD games they are not very innovative or ground breaking its just a FPS. But it's the lowest common denominator so it wins the big bucks. I never liked the creators for there stance on console vs pc. That's a more important story than if they get paid or not for me. I wish blogs would run that story instead. How developers are ruining the game industry by dumbing down games to fit on consoles. To fit that player base. And then not supporting the PC in the way it should be supported. Now I love consoles as much as the next guy but my PC will always win over anything a console can do and when a game I love gets a sorry ass port because "it was just easier to make a console version and port it to PC" I get very ticked off. Again, just my opinion. I know why they do it though it makes the most money. And there is no real argument against that. It makes money it wins. Sad truth. =(

The employees should sue for the rights to IW then just hire back vince and Jason.
Who else feels like vince and Jason should have named thier company finite ward?

I had a hunch that Activision was the wrong one in the Vincent and Zampella case but I didnt want to side until the outcome came with clear results...but come ooooon....
To get sued by 38 people while you still have the original suit pending...equals a lot of money spent on lawyers that could be spent on improving products...
I dont think 38+ those that have already left would lie about not getting their money, as it would make no sense financially to spend all that money on a lawyer and that whole process...
I guess I really won't be buying anymore Activision games....new that is(gotta love ebay..i get my game and they dont get any of my money)

And you don't think suing for HALF A BILLION DOLLARS won't amount to improved products? If i found 1/100,000th of that money, i would be debt free and actually enjoying life with my kids.

suing for 500 mil does not equal having 500 mil. There is no indication of how long the suits will last. There is also no guarantee that Activision would use the money gained from being able to keep the bonuses to improve the products. It's bonus money, so im assuming they would take that money and put it into their pockets (and continue on as if goals werent met and bonuses werent handed out).

Actually yeah thats all i need, but being a single dad who gets only $100 a fortnight taken off me for debts and $60 a fortnight spending money, its going to take a while to pay it all off, especially since i can't work due to no local daycare vacancies and my kids aren't school-aged.
