Legal? No. Nintendo could have it taken down if they wanted. Having said that, every big name OST (and plenty of no-name OST's) from a video game released in the past twenty years is up on Youtube, and there really is no stopping it. If they have it taken down, someone else will put it right back up.

As for Wii piracy...well...most of the game blogs have written articles about how to get an .iso loader working on the Wii. Joystiq is one of the few holdouts, and it's not like linking to SMG2 music on youtube is encouraging people to pirate games in any way, shape, or form anyway.

All I meant is that an innocent 8 year old (about half of joystiq's readers, give or take) might go on the video and see "Super Mario Galaxy 2 download" and will think "OH BOY now I don't have to go to Wal-mart!". It's an easy induction. All I'm saying is: beware.

Hmmm... I don't hear that for some reason. Purple Comet, however, I hear the best music in a video game ever. Although, I do love FFXIII's soundtrack almost as much.

Is this game as easy as the first SMG? My biggest issue with SMG was that there was literally zero difficulty to the game at all.

Galaxy 2 hasn't shown me anything that blows Battlerock out of the water, but it's still early...(12 Stars, up to World 2--I'm taking my time...)

Actually no, it's not that simple.
Granted youtube does grant immediate downloads to any of its videos, but there are millions of addons and websites dedicated to ripping video, or audio from youtube.

In addition to that, this user is, without Nintendo's permission, broadcasting their soundtrack.

It doesn't matter if it's audio or video, this is still Nintendo's property and the user is not allowed to host it online.

I hadn't realised Mahito Yokota was the soundtrack composer.
But we don't know if it's actually him or not, the channel page is very bare with no details what-so-ever.

I mean anyone can register the account MahitoYokota, really. If I were to publish my work on youtube I'd actually say something.

Jenks, I'm concerned about copyright because I want to find work in an industry like animation or video games, where copyright is a large concern.

If everyone is nonchalant about maintaining copyright, to the point that general blogs like Joystiq freely link to potentially offending sources, then I may have trouble holding a job.

Although that was also when I thought Joystiq where reporting on some random youtuber illegally sharing the soundtrack, and not the soundtrack composer himself.

But still, I STILL find it suspect because Nintendo is such a big company with its own official websites, to upload the soundtrack to youtube is odd...

Guys, chill.

While Rupee's viewpoint may be considered a little...extreme...he still has the right idea.
It's technically not within the person's rights to upload the soundtrack.
Even if it's the actual composer who is uploading, doesn't he need to have permission from Nintendo as well? Either way that's beside the point.

There's a reason you don't see full length movies on Youtube, and that's because it's not legal.
Same should apply here.

Either way, it's not a big deal unless Nintendo makes it one, so for the time being, move along and don't worry about it.

A friend of mine is going to college in Austin Texas for 3D modeling and game design/development.

He recently decided to make a game with another friend over the summer using RPG Maker. He sent me a test clip with some of the ideas he had for music (Final Fantasy 7 songs) and battle animations and whatnot.

I first told him, "If I were you I'd change the music, otherwise Square Enix could claim copyright violation and make you stop working on the game, or change a good deal of it."

He replied with, "Well it's not going to be sold, and it's just for fun."

Me: "It doesn't matter if it's for profit or not, or if it's for fun or serious. It's still their music and they get to decide how it's used."

Well a day or two goes by (and he's included even more copyrighted songs now) and he sends me a message.

Him: "Well I asked my teacher, he's been in the industry for a long time, and he said as long as I don't sell the game then it's fine. Stuff like this is actually encouraged in the game industry. Companies are cool with it."

Me: "Your only hope would be a 'fair use' claim, and that wouldn't even apply here. I don't care how long your teacher has 'been in the industry', it doesn't make him an expert at the legal side of things. Copyright law is pretty clear on this."

Him: "Well my teacher has worked for big companies and been in the gaming industry for a long time, so I think he knows what he's talking about."

Me: "He's still wrong. Here's a link to a .gov site that explicitly says what you're doing is copyright violation. Here's proof straight from the government."

Him: "F*** the government. Not like this president or current government has done anything good in the first place. Screw them. My teacher said it's okay. Besides, it's just for fun and to include in a portfolio maybe."

Me: "Okay. Well whatever then... if you don't care then, but I can already tell you that it would be better if you just found songs licensed under creative commons online. It's your game and portfolio though..."



Moral of the story? Even some "professionals" who've "been in the industry for a long time" can make really stupid mistakes and swear by them.
