You know I what. I'm going to trademark the word "The" so now whenever any company decides to use that word for anything I'm going to....

I already did and you used "the" twice. You owe me two zillion dollars.

And I don't want any "but". I registered that one too.

EA Active was released in May of 2009, and of course it was known about in development months before that. What made them launch the lawsuit NOW?

SOP for an IP troll is to build damages by letting the violation stand for long enough to be 'real bad' but not long enough to be stale and seem uncredible.

I'm sick and tired of Trademark law in general.

A marketing firm? Yeah, I don't get it either. It's as if they knew that a lawsuit against a video game giant would get some sort of press coverage for an unknown firm. ... Oh, wait...

This is a videogame blog, why would you want one of the biggest publishers to go down? Not that they'd lose every penny, but still.

EA to lose every penny?! But then they couldn't publish Mirror's Edge 2! (Yeah EA, this is a fan awaiting an announcement from DICE to start developing right away! I'm hoping E3 announcement...)

EA is the 2nd biggest game publisher in the industry, I'm sure they wouldn't lose every penny. I just like being negative towards giant corporations.

While we're at it...

Down with Microsoft and Apple! Who needs Windows or OS X when you can have Linux?
Down with AMD and Intel! Who needs their processors? Let's just have the Linux guys make a free one!
Down with nVidia! Let's all switch to on-board/built-in graphics chips!
Down with Sony and Nintendo (and Microsoft)! Who needs proprietary machines when you can easily play flash games and indie games on the computer?
Down with Valve, EA, and Activision! Who wants their PoS games anyways? It's all about flash games and indie devs!
Down with AOL! Who needs programs like AIM or sites like Joystiq anyways? They're both full of ads and neither one has much real content.
Down with Google! I built my own search engine back in college and I only use that.
Down with Wikipedia and free information! I'd rather go to a public library and use a real encyclopedia.
Down with major oil companies! I always bike everywhere I go, even if it means biking across the country!
Down with Mozilla, the Chrome team, the IE team, and the Safari team, and even the opera team! I use a browser made by a tiny team who releases it for free and doesn't even try to make any money off of ads, search terms, or physical products. Sure it's riddled with bugs and security holes, and yeah I almost had my system become part of a botnet when using it, but at least it wasn't made by a corporation!

This is like a pie shop making a special called "Sweet, Delicious Pie" and then a TV studio claiming "What the--? You stole a line from our screenplay!!!". This "Active Network, Inc." sound like a bunch of scrotum faces.

Wow, shocking that a videogame blogger doesn't know the Active network, but you know people that are active and participate in running events, Active is huge and is involved in some way (ticketing, sponsorship, etc) with every running event (5k, 10k) I've done. And you know, people that the EA Active "games" are targeting would probably know Active. I think it is a very legitimate lawsuit.

I personally find it pretty lame, even if I knew what Active was, I'd find it hard to understand why anyone would see EA Sports Active and think it has anything to do with Active. And even if they were dumb enough to believe so, a little bit of research never hurt anyone.

Its kind of pitiful that in the modern world, we are refrained from using words from the dictionary just because another company used it, it would make more sense if it was an obvious use of a brand name, like EA Mc Donalds, or EA WWE which are all pretty specific, but Active? Come off it ¬_¬

So you're saying they're unrelated in any way then?

I won't go so far as to say a company shouldn't protect their identity but the idea is to not be confusing to a customer.

"Sorry, I know you wanted tickets but I bought a video game instead"
Doesn't really work does it? I tried that with my ex, she didn't buy it anyway.

Stupid reasons for suing people nowadays.

I'm active, oops, I can't say that, I may get sued for infringement of the word active, commonly found in the dictionary ¬_¬ Hm, I'll use Dynamic, Energetic and Lively instead, oops, I cant use those, because someone someplace has copyrighted all the words in the dictionary.

Whats the point children learning to spell if before you are born, all the words you want to use are copyrighted by some company, lol

here in america we don't "grow up"... we do whatever is necessary for success.

My god! They're using the word 'Active' in their title? We're using the word 'Active' in our title! There must be some way we can make money out of this to account for the massive losses we've incurred from no advertising, poorly researched products, our embezzling accountant, and that shady investor from Rio! I know, let's sue them!

did any of you numbskulls read the document? they're suing over Active 2.0, which is the next installment EA is working on, and from the looks of it they've got a pretty solid case. They'll have to prove that there truly is confusion amongst the general population of EA's and their customers, but to be honest, it's a blatant infringement of trademark law.
Read the article before you respond, because I'd really rather not waste my time reading opinions written by the uneducated and mentally handicapped. (Guess I probably shouldn't be on the internet then, huh?)
