Active Network Inc. has filed a trademark infringement suit against Electronic Arts over the EA Sports Active series. IGN obtained a copy of the lawsuit [PDF link] wherein Active Network claims EA is infringing on its "Active" trademarks, which -- as you must already know -- are "famous, arbitrary, and highly distinctive, and are recognized by the public," according to the suit. You are familiar with the famous Active Network, aren't you?
EA declined to comment on the adjective-packed lawsuit.

I use a browser made by a tiny team who releases it for free and doesn't even try to make any money off of ads, search terms, or physical products. Sure it's riddled with bugs and security holes, and yeah I almost had my system become part of a botnet when using it, but at least it wasn't made by a corporation!

I actually am familiar with Active Network, because the company I work for uses an event management service that was bought by them. And I get stuck dealing with that shit.

Wow, shocking that a videogame blogger doesn't know the Active network, but you know people that are active and participate in running events, Active is huge and is involved in some way (ticketing, sponsorship, etc) with every running event (5k, 10k) I've done. And you know, people that the EA Active "games" are targeting would probably know Active. I think it is a very legitimate lawsuit.

I personally find it pretty lame, even if I knew what Active was, I'd find it hard to understand why anyone would see EA Sports Active and think it has anything to do with Active. And even if they were dumb enough to believe so, a little bit of research never hurt anyone.
Its kind of pitiful that in the modern world, we are refrained from using words from the dictionary just because another company used it, it would make more sense if it was an obvious use of a brand name, like EA Mc Donalds, or EA WWE which are all pretty specific, but Active? Come off it ¬_¬

I won't go so far as to say a company shouldn't protect their identity but the idea is to not be confusing to a customer.

My god! They're using the word 'Active' in their title? We're using the word 'Active' in our title! There must be some way we can make money out of this to account for the massive losses we've incurred from no advertising, poorly researched products, our embezzling accountant, and that shady investor from Rio! did any of you numbskulls read the document? they're suing over Active 2.0, which is the next installment EA is working on, and from the looks of it they've got a pretty solid case. They'll have to prove that there truly is confusion amongst the general population of EA's and their customers, but to be honest, it's a blatant infringement of trademark law.
