Nah, they're probably pulling a Traci Lords--trying to prevent anyone and everything but themselves from having the opportunity to profit from their name...whether it be through official channels, or ebay, or whatever.

Or maybe they're just environmentally friendly, and, realizing if they win, all that stuff will essentially become trash for Zynga, they want to make sure it's disposed of responsibility (this one's a long shot).

I really hope they can settle this soon, as a customer who hates confusion I would really hate to be confused by the title when I walk past and subsequently purchase neither of these games.

It seems unfair that DC had the name first and Zynga came in later, but if DC cared about the name so much they really should have registered it.

Zynga's in trouble. Not only is it common law to not have to formally register a name once created(as it's automatically copyrighted and what not), but they have proof that Zynga actually KNEW about the name before they filed for the registration?! How will Zynga get out of that one?

They;re stuck between a rock and a hard place. It makes lawful sense to settle since there is clear evidence of them violating common law(assuming what DC says it has), but on the other hand the name Mafia Wars has made so much money for Zynga that the CEO and lawyers have no choice but to fight and hope that somehow some way they win.

Does this really matter in the end?

In a little more than 2 weeks time, 1/3 of us will be talking about Halo. A 1/3 of us will be talking about how we're fed up hearing/reading about Halo. A 1/3 of us will be too busy playing Halo.

From what I understand, registration is not required for a copyright. The point of creation is when it is established.

This is a nuisance suit that is probably seeking an out of court settlement. I'm sure most people NEVER heard of Digital Chocolate's version, or of Digital Chocolate for that matter. I think a lot people have heard of Zynga's Mafia Wars. Worst case, Zynga simply adds their company name in front of the title to denote their version.
