SouthPeak Games CEO Melanie Mroz told investors this week that the ongoing legal argument between her company and distributor CDV has been resolved, and while full terms of the agreement weren't released, SouthPeak attributes a solid chunk of its $5.8 million in losses to the legal issues. Mroz says "the litigation costs of $3.2 and 3 million" that the company had to pay "were mainly related to CDV."
Next up, the company wants to "put these matters behind us and continue to focus on our business and future growth," but not without My Baby. SouthPeak is still embroiled in the fight over that title with Nobilis and Majesco. Chairman Terry Phillips says that SouthPeak feels the My Baby title "is our series, so we're still hoping that that can happen."

Does anyone else feel like this legal battle was a huge waste of time over a really meaningless, generic IP title? It's not like it was exceptionally clever or culturally significant.

Cleverness and cultural significance are not things that matter to shareholders. While we gamers may be concerned with the quality of our games primarily, we have to realize that the rest of the world still wants to make money. That series of games has been wildly successful for Southpeak. Problems with it could ruin their revenue stream.

This particular legal battle was not over IP, but over distribution.
SouthPeak has a 2nd lawsuit (mentioned in the 2nd paragraph), that is still ongoing over the MyBaby franchise. MyBaby is a cash cow. It debuted against a few other baby sims, and beat the others hands down in sales--the other ones tended to be uglier and a little more awkward, and MyBaby debuted at a lower price point too, which it then held without the price reductions common in many titles. It then migrated quickly and successfully to the Wii where it continued to outsell its few competitors. MyBaby looks strong graphically compared to its competitors (even its packaging was a step up), and the gameplay is crazy simple beneath a faux exterior of "simulation"--I believe this gives it a very wide appeal across age groups, and has a nice balance of play vs. reward.

Screw SouthPeak for making Boombots for the PSX. I bought Boombots about 10 years ago thinking it would be pretty good and god that game was so awful.
