Don't companies get fined for breaking street dates for games, or is there some sort of exemption for shipped vs. in-store releases?

@evilspoons That only applies if the game is street dated. Not all games are. In fact, a lot aren't. If they aren't specifically told to hold it until a specific day, they'll sell it as soon as they get it in.

Yes, but only if the game has a hard release date, not all games do. The Kinect certainly does, but I remember you could buy Wii games before the Wii came out.

@evilspoons Yes, they normally do. But this is Gamestop and they'll probably just get a slap on the wrist. For the record, the game is street dated for the 4th, so they would be breaking street on it.

What's weird to me, beyond anyone buying this game in the first place, is People who bought it now and are having problems caused by it decided to put in their 360, even though they can't play it? Is there a controler option to play the game? Why did these people put the game in?

Most people aren't smart enough to know they got something before it was supposed to come out. Most people just aren't smart period.

@Hoops This is exactly my thinking. From The articles about it, it sounds as if they got the games but not Kinect. I'm sorry but it seems quite stupid to think, "I'm missing a piece of hardware required to play this game, but i'll pop it in anyway." I feel bad for these folks unable to access Live for a week, but c'mon people think before you act.

What I want to know is if the people who were in on the xbox live preview program have this issue. I swear I get an update every 2-3 days from being in the preview program.

@donatom3 let's be clear, the preview program is a beta program, you get regular updates (sometimes everyday on such programs) because you're expected you're testing out *the very latest*.

If you don't want *the very latest* (you sound like you're complaining about getting frequent updates) then don't sign up for the program - pretty simple.

@stephbu Sorry I guess my post did sound like I was complaining. I guess I was more illustrating the point that there have been many updates to the new dashboard that there is no way the version that's on the disc is the newest one. I know they have to contain a version on the disc that will upgrade all the people who don't have internet access, but the version on the disc has to be atleast 3-5 revisions old by now

I think it's complete BS that Gamestop has not offered any compensation (who knows, maybe they will). It's their fault that they shipped early. One week without XBL is not insanely long, but it's long enough if you have nothing else to do or you're missing Halo Reach daily challenges. GS should at least send out 400 or 800 MS points to all the people who received Kinectimals early. I think that's reasonable.

From the article though it sounds like these people got the kinect games and not the hardware, if that's the case and none of them have the hardware then why did they stick the games in? sounds like stupid people going and buying from a company that doesn't have any intelligence in the first place (gamestop)
