@Kirkpad He was complaining about it back in 2008. Some people may remember Axl's famous "nonsensical Guitar Hero rant" from around then:

My guess is he filed the suit way back then, and it only recently got to a point where the outside world got to look at it.

@vidguy Oh, I didn't notice that the document itself was linked to. Crazy, then, that he complained about it two years ago and that it didn't get filed until now. Lawyer stuff can be pretty slow though, I suppose.

This is true. If it wasn't for his voice, he'd be worthless IMO (and he has been for a long time now). I hate activision as much as the next person, though, so I want them to lose this.

It was in Axl's interest to delay filing suit. The longer he waits (as long as he files within the statute of limitations), the larger the eventual damage award. If he sued before the game was released and was successful, all he could do is prevent the game from being sold. If he is successful now, he will get a percentage of all the profits from the game.

That is a pretty weird contract provision, though. It's not like Axl himself was included in the game without permission.

Read the complaint: basically it stems from Axl's overwhelming desire to keep the media and public from associating Slash with GnR. Pretty weird, but this is Rose we are talking about.

Keep in mind that allegations in a complaint aren't fact, but the best line from the complaint: "Time Riley from Activision was in attendance [at a NYC concert] and approached Rose after the show. In tears, he apologized for the way in which Rose and Guns N' Roses had been mistreated by Activision. He said "I can't sleep at night" and asked Rose to forgive him."

Oh boy.

Courts aren't stupid. The longer you wait to file this kind of suit, the worse your chances are.

If you don't attempt to mitigate your own damages, judges will remember that and award you less. The best action in Axl's case would have been to file immediately to minimize his own losses. That way the court would look favourably upon him as mitigating his losses, but now they'll see him as an opportunist.

What you are talking about is the defense of "laches." There are some situations in which a court will say that the plaintiff (here, Axl) waited too long in bringing suit and shouldn't get the benefit of that delay in racking up damages.

But the defense is an equitable one and is in the court's discretion to apply. More often than not, courts choose not to apply laches, and the plaintiff will get the benefit of going after a defendant with deeper pockets.

Unfortunately, this type of thinking is important for lawyers. I remember my tax law professor really drilling home the fact that you want to wait until the last day to file a suit against the IRS so they have little time to react.

I love GnR's music (that is to say, prior to Chinese Democracy... not terrible, but not what I'd want to hear from GnR), but... seriously?

This contract is pretty sad and pathetic. Yes, Activision broke it by including Slash and VR, but it's say how petty Axel acts over this. Maybe I don't know the whole story, but he comes off as seeming childish.

And... filing this now? That's like being the guy who cries "F1RST!" on the third page of comments.
