Hey Capcom, here's an idea.

Take MaXplosion off the app store, and partner with Twisted Pixel in bringing Splosion Man to the iOS platforms.

Here's another idea:

Making the game free on the App Store and acknowledging that they were "inspired" by Splosion Man would go a long way toward that "trust" they want to build up.

In business terms, this is called "Good Will" and it's hard to buy after a major FAIL like this!

Only way to save face, which automatically means they won't be doing that.

Capcom's starting to act like sega used to years ago before they got bought out by Sammy, bumbling through every decision they possibly could and wearing out what's left of their fanbase. If they were going to ignore the similarities between the games they should have never issued this statement to begin with. Copying the game is one thing acknowledging the mistake without fixing it just makes them look arrogant.

I think the game should be pulled from the App Store if they are truly sorry. The Capcom Mobile team, at least those responsible for MaXplosion, should also be fired.

Why should the dev team be fired? The in the gaming industry the guy paying the bills and the executives call the shots, the developers would be fired if they spoke up.

Yeah but at least it appears that it is not a case of the same people at Capcom hearing a pitch for Splosion Man, turning it down, and then the same people creating their own version of it.

Oh, Capcom, you so crazy. Now take it off and publish 'Splosion Man.

How did it go from concept to App Store with no one saying, "This will lead to trouble"?

Heres how it happened.

Capcom Mobile boss: I saw 'Splosion man getting a lot of good press, make a clone of it for mobile.
Dev team: Umm, isn't that going to cause some legal problem, and what kind of timetable and creative leeway do we have?
Boss: Its an indie game, they have a legal budget of approximately 1/64 of our janitor staff salary. And your leeway is you are allowed to pallet swap the characters, and change up to 5 letters in the game's name, and you should have released it already.
Dev: I hate my life.
Boss: Do that on your own time.

"Jumping, platforming and attacking via a single function, 'sploding" isn't the same as "cover". The concept behind 'Splosion Man was fairly original, and Capcom stole it. Dat's dat. The fact that the name is so similar is just pouring salt into dem wounds.

Capcom needs to issue a real apology to Twisted Pixel. Those guys don't deserve to be treated like this just because they're a small developer.

They didn't use an idea, they copied the entire game. It's basically a clone. Now, in this business ideas get copied all the time, but ripoffs this exact and blatant are more rare. And it usually does work out in quite this fashion. Here you have Capcom, a publisher, declining to publish an indie game and then ripping it off for another platform after it met with success. It's not like Capcom ripping off EA. There is absolutely nothing stopping Capcom from saying, "Hey, good job, we want to publish an iOS version." They just went ahead and stole it because they could.

"Saddened" simply isn't good enough when nothing is done to alleviate the cause of said sadness. Capcom, you need not only to take MaXplosion off the app store, but there should also be an investigation into the 'design' that occurred at Capcom Mobile, promotion should be redirected to Twisted Pixel, AND then perhaps think about parodying this incident in your future games. Or have Splosion Man ads in Dead Rising 3, something like that.

PR goes a long way, and you'll lose a lot of respect from fans throughout this if "we're sad" is all that can be mustered.

Yeah, it's not just one mechanic. If they had made a game where the primary mechanic was exploding, but the story and characters were different, not much would have been said.

But they made a game about a science experiment that results in a creature that can make itself explode, and that creature then has to escape the evil lab where it was created, by using it's exploding ability.

That's the exact same game as Splosion Man. The backgrounds and character designs even look very similar. Even the titles are only separated by a couple of letters.

Everyone is not realizing that Capcom already funded the project so not releasing it means money lost from producing the game in the first place.

Why not give Twisted Pixel some royalties or something. Therefore the fans, creators, and Capcom will be all happy.

I don't see where the problem is. Two products compete for customers. At the end the better one will prevail.
Maybe Splosion Man is the better game. Then customers will get that one.
But maybe Capcom's game is better, so it's good that there's an alternative.
Maybe they're both good. They both will get their share.
Maybe Capcom is the bigger company and can put more money in marketing, but Splosion Man surely already has a loyal fan base. Maybe Twisted Pixel can figure something out to counter Capcom's new rival game (that has something to do with a smart business model and not legal action. But they already said that).

The thing here is video games are considered media/art. Plagiarism and copyright violation is a serious offense in such an industry. In fact it has all but destroyed the film industry (outside of the initial fire that was set with the creation of "blockbuster films" when the abomination that is Jaws released). This day and age there isn't much a small time developer can do legally, and that will never change. But we as gamers and the media should stand up for the little guy. The people driving innovation in an industry that has become about "manufacturing games" rather than "creating games."

I get what you're saying, but if you worked on an idea for years, lets say a pair of shoes that can make you literally double jump(???). After all your hard work you pitch it to Nike saying hey I got these shoes that can make a person jump off thin air. They say "no one will want those". So you spend the time, money and effort getting it to market yourself.

When you finally do, and the shoes are a huge success, Nike comes along and steals the idea and makes the exact same shoes, cause they know (a) you don't have the money to challenge them legally and (b) their name is stronger then your's in the market. Are you saying you wouldn't be angry at all?

I don't think your considering that these are indie studio's and Capcom is playing with their livelihoods...

@Anticrawl & FrodoTBAggins

First of all, you can't steal ideas. Stealing means taking something away from you and then you don't have it anymore. Everyone can have ideas, but you can't own them. You can't own something that is not tangible. And everyone can have the same idea completely independently from each other, even if they draw inspiration from someone else who has a (very) similar idea. That doesn't mean that that someone suddenly lost this idea.
I think anyone should be able to create things that he is sure he will be successful with and should not be hindered by the fact that someone else before had a similar creation. And since everyone is equal and has equal rights it shouldn't matter if it is a gigantic company or a tiny little indie developer. Even tiny little indie developer draw their inspiration from somewhere else. And since you already brought up the mention that video games are art (which I think too), remember that art always has its basis in copying (not stealing!). Nothing is ever new.
And regarding the notion that the film industry is destroyed or dying: That's bullshit. How can that be when there are today more movies produced than ever before? How come that the MPAA is reporting a new box office record every year?
tl;dr Jaws is an awesome movie

@kingalekz There's a reason we have a crime called plagiarism, you know. Imitation is not at all the same thing as actively gathering information on a game, refusing to pay them for it, and then using said information. And whatever else Capcom says, I believe it is a single corporate entity and so could be held liable for that.
On the other hand I'm hardly a copyright attourney, so I could very well be wrong.
