Sony's claim against hacker Georgen "geohot" Hotz will have to find another day in court, as a trial has been delayed due to questions of where the case should physically be held. Currently, the case is being reviewed in San Francisco, but district court judge Susan Illston raised questions as to whether the case should be tried in California or New Jersey, where Hotz resides. Sony's lawyers have argued that, because the hack was distributed via Twitter and YouTube (both based in California), the case should continue. In addition, Hotz supposedly received donations via PayPal, another California-based institution.
"If having a PayPal account were enough, then there would be personal jurisdiction in this court over everybody, and that just can't be right," Illston responded.
The case is delayed pending further discussions over jurisdiction, a decision Sony is likely to frown upon. Given the free availability of the hack online, it's in the company's best interest to try and secure a victory as quickly as possible -- even if it means little can be done to stop the proliferation of the hack.
Update [1/24/11]: Some of the court documents have been posted on PSX-SCENE, providing greater detail of the two sides' arguments over jurisdiction.

Thanks to him, Modern Warfare 2 online is completely ruined. 80% of all games I join now have people using wallhacks, god mode, unlimited ammo, rapid fire, super jumping, unlimited AC130 etc. Basically the PSN is totally screwed. Every single game now is going to full of cheaters online. Geodick can go jump off a cliff for all I care.

Is it really that bad? The only console I own is a Wii and I don't play anything online with it, so I'm not in the loop about how prevalent these hacks are but that seems ridiculously awful.
If hacks are actually that rampant, then this guy really is a jerk; until now I was 100% behind him and his right to reverse-engineer his own property and distribute that information but if it's genuinely ruining the experience of every other online player in such a direct way... wow. Incredibly irresponsible.

@KamiKaji Guess what? It isn't his fault. Sony designed the PS3 with massive security flaws (useless hypervisor, kernel exploits, using public-key crypto without any random number blows my mind). OtherOS was the only thing keeping hackers tinkering elsewhere. When they removed it, all hell broke loose.

Someone else would have broken it, its not as if geohot made the flaws happen, they were in the system the whole time.

@Caerus Exactly. I was originally rooting for Geohot, because I believe that an electronic device that you buy, you should own and be able to do anything you want to it. Different story with the PS3 though. If the PS3 is compromised, so is everyone's experience. Boy did he choose the wrong platform to hack. He has indirectly ruined the online gaming experience for almost every PSN user.

Just as with iPhone jailbreaking, this is probably legal as an exemption to the DMCA in the United States. Everywhere else without a DMCA, this is certainly legal.

look, it was obvious that Sony doesn't have much of a case, especially if they bring up the Apple jailbreak case, but that doesn't mean that this guy didn't open up pandoras box on the PS3. plus you're gonna have the PRO Homebrew crowd that will say that not all want to pirate games, true it doesn't, but you have to realize that excuse is sh!t covered with sugar coating, because chances are if you could then you will because you can. This may not pertain to all but it does for alot.

Agreed man. I'm a pretty laid back guy, I like to just relax and play some video games. It's really crappy that this made MW2 unplayable, who knows what other games it will ruin too. I just don't understand why people have to ruin things like this, why can't we all just chill and play some f***ing video games.

As for the hacking on MW2. This was rampant on 360 and PC as well. As stated grab Black Ops, its much better then MW2 when it comes to cheaters. I know it's shitty but in reality Black Ops is way more balanced of a game. It's respawning sucks but the perks are ok.

That's like suing McDonald's for making you fat in Ohio because McDonald's HQ is there. People outside of the U.S. (provided those aren't blocked in their home countries) use those sites. And Sony can make this right by having their games retail at launch for $50 or if they want people to buy, $40. Or I don't know include extras that pirates can't be able to replicate (cloth maps and plushies and coffee mugs and mouse pads and....).
