38 Studios head Curt Schilling elaborates on Kingdoms of Amalur: Reckoning online pass quest lockout

Yesterday, we reported that Kingdoms of Amalur: Reckoning will make use of EA's Online Pass system, and that used copies of the game will not include access to a specific quest line, similar to Catwoman's Online Pass exclusion from used copies of Batman: Arkham City. Initially, it looked as though the pass granted access to data already on the disc, however this was later clarified by a post made on the 38 Studios Forums, where community manager Muse informed the public that the quest line is in fact day-one DLC, rather than content actually on the disc.
38 Studios founder Curt Schilling has written his own statement regarding the situation, and it's just about as frank and honest as we've come to expect from Schilling over the last couple of days: "You can argue the merits and effectiveness of it, but right now it's how it's done and as someone that's as invested as I am in this company, I stand by what has happened."
Schilling goes on to say that the free DLC is intended to be an incentive to early adopters and a reward for "fans and gamers who commit to us with their time and money when it benefits the company." He does, however, realize that the situation could have been handled differently: "It is my responsibility as the leader to know of things like this and be aware that it would become an issue, I failed on both accounts. No one else is to blame, but at the same time there is no nefarious attempt to do anything under handed here."

I have two issues with the industry bashing used games:
1 - I buy used games to try the series or the type of game. I bought the first Uncharted used late into it's release. Enjoyment caused me to purchase the next two, new, for $60. Mass Effect 2 was also purchased used. So great, that i will pay $60 for 3 in a couple months. What publishers fail to realize is that $60 is a lot of money to experiment on if you like something. I have spent more on new games because I have purchased used. I do not believe there is a strict only new or only used consumer. We all double-dip and it betters the industry.

If I can sell my house, car, couch, guitar, etc, giving the same features to the new user, I should be able to sell my games in the same manner (sorry, the couch doesn't come with cushions). @woz3323 I have a similar argument as well. When I was a kid I grew up in a single parent household and saved up money from babysitting to buy games. For the most part, all I could afford to buy was used. Now I am an adult with disposable income and I buy all my games new. What would have happened if I hadn't been able to buy games as a kid? Would I have outgrown the past time really young and stopped playing? It's impossible to say but I strongly suspect yes. Used game sales have their place, too.

First off, content in the game is locked between 3 and 9 months before launch, depending on the developer. That means that no new content can be added to the game, only polish and bug fixing. Artists and designers finish about this time. This is also about the time they get laid off. What do they do instead now? They concept out and start developing DLC while the programmers are bug fixing.
All right, so the game is done, it's about a month and a half from launch because the game has to be approved by MS and Sony, then go to the disc creator. Again, a ton of people normally get laid off here. So what do they do? I don't see this as a bad thing at all. It's not necessarily a great game but I don't see any reason to hate them for it. They get no profit off of a copy that was bought pre-owned so they reward those who actually show them some love and buy it new. I think that's a great thing. I don't buy preowned games because I want to encourage developers to make more great games more than I want to save 5 bucks.

Rebranding day-one DLC as a "gift" to early adopters is certainly one way to go. Either way, the content was held from the full game near the time of release.

Ever since the online passes Ive never bought a game that supported online passes used, usually just wait for it to go on sale or rent it if I have my doubts about it. I see these online passes as a way to reward people for buying new than punishing them if they bought used. Sure if you bought it used from second hand either though a friend or rented, you would have to fork over the $10 to access the locked out content. I would never pay $55 for a used copy when for an extra $5 get a new copy and get the whole experience rather than just a portion of it. I am not saying buying used is bad, in most cases people can't afford spending $60 on a newly released title in this day and age. I've bought my fair share of used games and understand I am not helping out the developers who create these amazing works of art, so I am at fault as well. Bu what I hate is that this has become the norm with EA, Ubisoft, Sony, and will possibility spread to other big name companies like Rockstar, Bethesda, Microsoft, etc. You really can't do anything about it, we can stop buying these games which would end up having the studios close down cause of poor sales and used market taking away from new copies being sold. It's a really a double edged sword when you look at these online passes. Either way we and the publishers get stabbed no matter which side we chose.

@Art84 Don't buy the "Oh poor studios" argument. They are doing this stuff on consoles because the online infrastructure for consoles can support it. They will not go bankrupt if they quit doing this crap, they are doing it for one reason only: because they can. If they are on such thin profit margins that they would go bankrupt without doing this crap, then I am happy to see them go bankrupt. The video game industry existed for 30 years without this crap, I don't think it's in danger of dying any time soon.

I was just thinking... if they released this as day-one paid DLC (like a lot of games do) I don't think anyone would have even batted an eye. However, because they're giving it away for free they get all this rage for it. Am I missing something, or does this seem kinda backwards to anyone else? Is everyone mad because it's only free for people who pay more for it?
I guess I'm just kinda sad that people are deciding to not buy the game over this. It's such a rare thing when a brand new IP that looks this good comes out, that I think it's a shame they're losing sales over something like this.

As far as people complaining about needing the internet to down load, how is it that you are posting here, presumably using the internet, in the first place?
And for the people angry because they might not be able to get the code in a used game.../facepalm. You don't deserve the codes if you buy used. Buying used does not help the industry, it only helps second hand sellers. You want new games, but don't want to support the people who make them...Logic fail.

Prove it. Curt Schilling or EA's word here is not good enough. They've been hyping six factions since last summer. The game just went gold this month. Logic dictates they've been working on this content for months already and purposefully left it off the disc so it could be partitioned off as online pass locked content.

Schilling himself said the first DLC was planned for around the time Mass Effect 3 releases, about a month or so out, and would be epic in breadth and scale. So either this House of Valor content wasn't considered DLC even by him prior to this news, or they moved it up and have been misleading the public about six factions being included in the game all this time. A sixth faction and 7 quests doesn't seem to me to be epic grand scale content so I personally would say this wasn't ever really considered true DLC prior to this PR spin.

Even used game buyers deserve the full single player game that was promised long ago. A main quest and six factions. Just because you're a rabid fan of Amalur and would pay whatever 38S/BHG/EA asks, doesn't mean everyone else is, and doesn't excuse the exclusion of long promised content for renters/borrowers/used game buyers.

You can't definitively conclude "used games r bad" until a thorough study has been done on it's impact. Gamestop for example would probably be more than willing to share their preorder numbers.

Even if true, that's largely irrelevant. They are wholly different businesses: specialty retailer vs game developers/publishers. Like it or not, Gamestop is successful because they fill a niche. The used game market would undoubtedly continue on without them though. The money would flow differently, but it still wouldn't go to EA.

The code is a reward for supporting them, if you don't support them by buying it new then don't complain you don't get the code, it's that simple. It's ridiculous to say "I deserve to get the full benefit of someone who supported the studio and paid full price even though I waited a few months and then deliberately bought a copy that they don't get proceeds from." If you don't have money for a new copy then that sucks I know but that doesn't mean you get to complain about not getting 100% of a game that you didn't pay 100% of the price for.

I'm not too upset by this since I can tell a good chuck of the game is going to be included without the online pass. Elder Scroll vanilla and Fallout vanilla might miss out on many hours of gaming without their add-on content, but those two series already give you a hundred hours each game without the add-ons. I've a strong feeling Amalur will be the same. It's not the same as, say, Dirt 3 or Mass Effect 2... where it felt like the essentials were missing.

Solution: purchase games, with online passes, when they go on sale.
I got the Anarchy Edition of RAGE for $30 within a month of its release and received all of its DLC. Same goes for Arkham City, although that was for $4 and the day of its release.

Even though its an EA game I was considering playing this because its written by R.A. Salvatore... Now I am not so sure. I played the demo it was fun enough but this kind of thing deserves a boycott imo.

This is just they're way of trying to get some compensation from people pulling an end-run on them to avoid paying them for their work. If price is a concern, there are sales and deals all over the place; the only good reason to buy used is if a game is out of print and you can't find a new copy. Otherwise, you're just going out of your way to deny the developer and publisher a sale.
