@TheManEl I'd say it sucks to be him every day, being such a snivelling piece of trash to steal other people's ideas without any sense of remorse. I don't care how much money he made, with his mentality I'd imgaine he wasted it all on worthless crap. Apple taking these games down might be very useful if the true creators wish to sue him.

How come Joystiq never covered 6waves response to the Spryfox things? You know how the original company was developing before they were bought out by LOLAPPS and that Spryfox was the one to back out of the deal with LOLAPPS.

That's only Spryfox's side. I mean the original company that made the game before LOLAPPS bought them out. They made a statement to back them up and few sites have bothered to report on it.

I agree the Joystiq should cover the denial, but it's hardly surprising that 6L is denying that they have done anything wrong. Has any company ever just fessed up as soon as someone pointed a finger at them?

It's also interesting to note the specific language used: That they did not violate the NDA. He defends against something that's not actually in the lawsuit. He sets up a kind of strawman argument by saying that, "Exhibit A is not in the lawsuit, but we definitely did not have anything to do with Exhibit A." Well, that doesn't actually address what the legal question is.

The defense also seems not to gel with the timeline. He claims that they did not acquire Escalation until after Yeti Town was released, but internal records show that 6L published Yeti Town. If that's the case, they had business interests and ties to Yeti Town before it went live, even if they did not develop it internally.

You also didn't provide any proof that it was Spry Fox who backed out, you just made an unfounded accusation. Spry Fox has correspondence, made public as part of the lawsuit, showing that it was 6L who backed out of negotiations.

How I heard Spryfox backed out is from a friend who works at Escalation. He said Spryfox got upset that 6waves was in talks with buying them and him and he was upset that Escalation had released Yetti Town.

Yetti town was released around Christmas. I remember this because my friend was talking about how they just released it. They weren't bought out until sometime in mid-Jan. Which we all made jokes about the company's name (I mean c'mon, LOLAPPS?). Why 6waves is listed as the publisher for it now, I dunno. Perhaps because Escalation Studios no longer exists and they updated the information.

It may also be that your friend was not fully privy to the conversations going on between the three sides. The only public information is what is in the lawsuit, and what each side has said. Based on the public information, including correspondence, it appears that 6L ended the relationship.

As far as the suit goes, if it is found that Escalation did violate Spry Fox's copyright or work, then it will be 6L who is responsible, since they have purchased Escalation and taken on any legal responsibilities that Escalation would have had.

Lastly, the data and information provided by Spry Fox may have been what sold 6L on purchasing Escalation and Yeti Town. If 6L saw a better deal (percentage of profits and ownership of IP) by buying a copycat, after having had access to internal data of Spry Fox's work, that could still have a legitimate breach-of-contract angle, depending on how any NDAs or contracts were specifically worded.

It's understandable, most people don't. I know Escalation because the only console game they've worked on was Samba de Amigo for the Wii.

They only removed 59 titles? I like my iPad games just as much as the next guy, but there are *a lot* of titles on the app store that are blatant rip-offs, it's about time they do some serious cleaning.

The approval process isn't there to check if it's original content. It's there to make sure the app is not a virus, keylogger, or other malware.

The approval process doesn't consist of a person sitting down and using/playing said app, it's done automatically with a program that runs through the apps code to check for viruses, malware, & phishing scams.

Interestingly enough they do band some apps based on content, and do let some apps that violate their coding policies pass. Either their auto-check isn't that good, or there's a human involved somewhere. I'm pretty sure they'd also ban an app if it was based around illegal content.

They don't allow anymore fart-button style apps but they did let a C64 emulator get on only to go back and forth with the developer (remove it, let him put it back, remove it, etc.)

I wonder if Microsoft will take a similar stance and target some of the clones on their indie channel. While I know they dont exactly do much of anything (if at all) on the channel, there are some rip offs such as "Angry Fish" and "Fortress Craft"

Fortress came out before Minecraft was even officially announced for the 360 platform, and therefore the only way at the time to play a Minecraft-esque game on the system :)

Well its a lot more complicated. Is it the same style and type of game? Sure, but minecraft didnt just take every little thing and just reskin it. They took the basic principle and expanded upon it in their own way. Fortress Craft took Minecraft and made a console version of it. Course Minecraft has evolved so much since then that it doesnt even matter. I think people will forget FC when MC releases on XBLA. Terraria is another good example of a game that takes the same principles of mining and turning it into something different.

How many of those copycatted games are essentially clones themselves? Aren't they all pretty much the same tired puzzle/action game w/ a reskin?

Guess there isn't really much of an argument in that when the best-selling console game this gen is also nothing more than a yearly reskin.

This is sad to see. Both the copying and the level of crazy that the legal end of development is coming to.

Litigation will effectively kill off the profitability of mobile development if this kind of thing continues. Copyright only benefits those with the best lawyers.

Sad but true, I mean blatant ripoffs are one thing but one starts to wonder what games will never be simply because they might have enough passing resemblance to an existing franchise. Thus being deemed too risky to bother with (oh their game had jumping and platforms? deploy the lawyers!)

Did anyone actually read the article on Gamsutra?

It states all the "clone" games removed were from a single developer. So clearly Apple saw this a rip-off shop and they stopped it. It's that simple.

Doesn't mean there's going to be any change in review process or that every game is going to be examined subjectively to decide if it's a knock-off. But it clearly means your whole business is knock-off you're days are numbered.
