Maybe you heard about the verdict that just came out in one of the music file-sharing cases: <a href="http://www.abajournal.com/news/music_downloader_owes_record_cos_1.9m_jury_says">$1.9 million for 24 songs.</a> So, what does this have to do with gaming? More than you would probably imagine, since this gets to the root of copyright and statutory damages. In fact, EFF legal scholar Fred von Lohmann posted an <a href="http://www.eff.org/deeplinks/2009/06/record-labels-awarde">interesting piece</a> on whether the penalty is even Constitutional. Whether this is the suit that breaks the back of statutory damages has yet to be seen, but it's something that any media producer or consumer should be keeping an eye on.<br /><br />Of course, much of that may be getting ahead of the issue of explaining this decision in greater depth so that everyone can understand what the actual problem is. We've talked about copyright infringement and piracy at length on<em> <a href="http://www.joystiq.com/tag/law-of-the-game/">LGJ</a></em>, and the issue here is what comes after someone is found to have infringed on a copyrighted work: damages. I've mentioned before that both in the latter years of the previous administration and under the new administration, certain kinds of enforcement actions were increasing in number. Past commentaries in <span style="font-style: italic;">LGJ </span>have focused on trade, but another one of those areas is anti-trust. What got my attention in this regard was a conversation I had the other day with a partner in the firm who has dealt with a number of anti-trust issues. We were discussing the game industry, and he asked what the price range was on games these days. My response was a range, with the caveat that for pretty much all new PS3 and Xbox 360 games, the price was $60. His thought was that had to be on someone's radar screen to investigate, even if there's no actual anti-trust violation going on.<br /><br />Given the investigative climate, I would tend to agree, though based on what I know in the industry, I don't think there's any actual collusion going on. Instead, we likely have a case of 'conscious parallelism,' which isn't illegal per se, though a government official looking for their "big break" might just take on this case hoping to see a shift in the law from the higher courts. The recent <a href="http://www.google.com/url?sa=t&amp;source=web&amp;ct=res&amp;cd=1&amp;url=http%3A%2F%2Fwww.supremecourtus.gov%2Fopinions%2F08pdf%2F07-582.pdf&amp;ei=ScgdSsWvIZL4MO2MiMoF&amp;rct=j&amp;q=FCC+v.+Fox+Television+Stations+supreme+court+ruling&amp;usg=AFQjCNHvAOQKpY3-K45FkTKFRJ15JXBzOQ"><em>FCC v. Fox</em></a> decision seems to have gone relatively unnoticed in the gaming press. Yes, the case at hand was about broadcast media and the FCC, and yes, the makeup of the court is now certain to change since the decision came down. However, neither of these potentially distracting facts should take away from what this decision really is: yet another expansion of the government's censorship power over the public. If there is anything the gaming public should be paying attention to, given the continued anti-game activism, is successful control over other media. And there are really three major concerns that come from this ruling.<br /><br />First, I want to make it clear what this ruling is not. The ruling is not an actual victory for game opponents. While it makes some suggestions, the precedent can't be directly applied to the game industry at this time. After all, there is no governmental body to control game releases because those releases are not being made over licensed broadcast spectrum. After all, the government only controls TV broadcasts because the government owns the airwaves. More importantly, this ruling is not purely about censorship or the First Amendment. <br />We're all somewhat familiar with the endless stream of Flash games featuring some famous person: <a href="http://www.miniclip.com/games/presidential-paintball/en/">Presidential Paintball</a>, <a href="http://superobamaworld.com/">Super Obama World</a>, <a href="http://flashgamesite.com/play467game.html">Whack Britney Spears</a>, <a href="http://www.gameshot.org/?id=1345">Paris Hilton Jail Escape</a>, etc. An interesting question was posed to me the other day about these games: Is there a quarrel over the right of publicity related to Flash games? Obviously, retail games featuring certain public figures, such as professional athletes, are paying for the use of those celebrity likenesses. Flash games, however, are positioned much differently, and it's one of the more complex relationships between differing legal theories I've seen in the gaming sphere.<br /><br />While we've discussed the right of publicity <a href="http://www.joystiq.com/2008/10/03/law-of-the-game-on-joystiq-mo-madden-madness/">before</a>, it's worth reiterating that the concept is basically the equivalent of a trademark for a famous person's likeness. Think of it like a brand name helping to sell a product. A lot of people will buy a game just because it's made by Nintendo. Similarly, a lot of people might buy a game that appears to be created or endorsed by someone; be that a particular game developer or a celebrity. How many people initially bought <em>Madden Football</em> because of Madden's attachment to it? Probably quite a few. By now you're probably tired of reading about slick Hollywood-based video game launch parties attended by C-list celebrities and wannabes who probably game about as much as your grandma. Capcom finally got it right by opening up the <em>Street Fighter IV</em> party to the public. The only problem was that so many people showed up for the event that the fire marshal ended up restricting access, and a lot of people went home without getting their game on.<br /><br />For those of you who didn't make it to the Geffen Museum <em>Street Fighter</em> Takeover in downtown Los Angeles, we offer up the gallery below from the event. Right on cue, after this week's <a href="http://www.joystiq.com/2009/02/09/lgj-more-game-laws/">previous <em>LGJ</em></a>, Jack Thompson's Utah bill finally <a href="http://www.gamepolitics.com/2009/02/11/utah-legislator-officially-submits-jack-thompson-video-game-bill">made its public appearance</a>. Surprisingly, the bill amounts to only <a href="http://le.utah.gov/~2009/htmdoc/hbillhtm/HB0353.htm">4 lines of text</a> that will be edited into Utah's existing Truth in Advertising Act, a form of deceptive trade practice regulation. The entire relevant text of the statute is:<br /><br />
<div style="margin-left: 40px;"><strong>13-11a-3. Deceptive trade practices enumerated -- Records to be kept -- Defenses.</strong><br /></div>
<div style="margin-left: 40px;">(1) Deceptive trade practices occur when, in the course of a person's business, vocation, or occupation that person:<br /></div>
<div style="margin-left: 40px;">(u) (i) advertises that the person will not sell a good or service labeled with an age restriction or recommendation to a person under the age restriction or recommendation; and<br /></div>
<div style="margin-left: 40px;">(ii) sells that good or service to a person under the age restriction or recommendation.<br /></div>
<br />So what does this mean for the industry? I believe this bill has far more bark than bite, but it's more complex than a simple analogy. There are some potential consequences for electronic retailers based on this new potential regulation, but it also looks like this provision leaves a number of major loopholes that retailers can take advantage of. It's early 2009, we've just elected a new President, and there are quite literally a mountain of problems to be addressed on Capitol Hill. Our economy has been in substantial turmoil for roughly six months, with some problems stretching back for years. Many states are at or near bankruptcy. This economic crisis has, by now, hit every country on the planet to some degree. So, our legislators have spent the last two months rushing to put together proposals to regulate video games. No, no one's undivided attention has been on the economy during this complete mess. Instead, since the start of the year, it seems there has been an explosion of potential new video game regulations, from Jack Thompson's bill in <a href="http://www.joystiq.com/2009/02/06/jack-thompson-writes-bill-for-utah-tries-new-angle/">Utah</a>, to <a href="http://www.joystiq.com/2009/02/05/ny-strikes-again-with-another-video-game-bill/">New York</a>, to the <a href="http://www.joystiq.com/2009/01/13/and-the-band-fails-on-new-law-seeks-to-put-warning-labels-on-ga/">US Congress</a>, to <a href="http://www.gamepolitics.com/2009/02/04/australia-mmos-may-be-target-police-crackdown">Australia</a> -- just to name a few. And that's in addition to issues like the FTC's rumblings about DRM, which I've <a href="http://www.joystiq.com/2009/01/07/lgj-here-comes-the-ftc/">mentioned previously</a>. <br /><br />While this boom in regulations and potential enforcement may be great news for sites like <a href="http://www.gamepolitics.com">GamePolitics</a>, it's potentially bad news for game developers and consumers, not to mention the taxpayers who are footing the bill for all of this. A few weeks back, I mentioned that the <a href="http://www.joystiq.com/2009/01/07/lgj-here-comes-the-ftc/">FTC was looking into regulating DRM</a>. Well, in part on some discussions at the <a href="http://www.game-business-law.com/">Game::Business::Law Conference</a>, I have a sneaking suspicion that the FTC likely won't stop with DRM. In fact, I would be willing to guess that within the next few years, the often maligned End User License Agreement ("EULA") may fall into the realm of being regulated as further "consumer protection." Is it necessary? Well, that's a matter of opinion, really. The only certainty is that it will be able to bring in additional revenue for the government, which is certainly short on cash these days.<br /><br />If the FTC opts to regulate EULAs, I see three probable scenarios to accomplish its goal. Before I get ahead of myself, I should describe what the theoretical goal of consumer protection is: to prevent companies from taking advantage of consumers. Generally, though, it isn't necessarily the average consumer who's seeing the greatest benefit from the regulations. It seems around this time every year, with W2s and 1099s filling mailboxes, that someone thinks it's a good idea to bring up the idea of taxing the virtual world. The irony really is that most of these discussions are far from complete and often only address one potential viewpoint that could be taken. <br /><br />The latest commentary comes from the <a href="http://voices.washingtonpost.com/small-business/2009/01/irs_may_push_for_tax_complianc.html">Washington Post</a> (via <a href="http://www.gamepolitics.com/2009/01/12/irs-should-look-taxing-virtual-goods-says-tax-advocate">GamePolitics</a>) with further follow up on <a href="http://nwn.blogs.com/nwn/2009/01/irs-report-reco.html">New World Notes</a> based on a recent <a href="http://www.irs.gov/pub/irs-utl/08_tas_arc_intro_toc_msp.pdf">publication</a> by the IRS. Their basic contention is that the essential difference in the Terms of Service between the <em>Second Life</em> model and the more traditional MMO model (i.e. <em>World of Warcraft</em>, <em>Ultima Online</em>, <em>Everquest</em>) would mean different tax treatment. This week I've been at the <a href="http://www.game-business-law.com/">Game::Business::Law Conference</a>, and one of the speakers was <a href="http://www.game-business-law.com/speakers-holtman.html">Jason Holtman</a>, Director of Business Development / Legal Affairs for <a href="http://www.valvesoftware.com/">Valve</a>. Jason set out a fascinating theory on piracy: The majority of 'pirates' are just underutilized customers. <br /><br />This certainly sets forth an interesting business proposition, but also interesting possibilities for legal strategies related to piracy management and IP protection. I do want to caveat that this is building on a theoretical basis, and that doesn't necessarily mean any of these strategies is optimal for any given company. I want to summarize Jason's viewpoint to better frame the discussion. <div align="left">Activision's CES keynote should have been titled "Remedial Gaming 101: A History of Gaming." Activision Publishing CEO Mike Griffith took us through a not-so-brief history of gaming, from <em>Pong</em> to <em>Pac-Man</em> to "even games that used to feature trackballs, and yes, even joysticks." Although, that's not the point when the chap in the photo above fell asleep -- that happened <em>much</em> earlier.<br /><br />Oddly, Activision didn't manage to fit in a single plug for its upcoming game <a href="http://www.joystiq.com/tag/prototype/"><span style="font-style: italic;">Prototype</span></a>, which was apparently left out on the show floor for this one. No banners, no teaser, not even a still. Instead the stage was littered with games from 2008: <em>Call of Duty: World at War, Spider-Man: Web of Shadows, Madagascar 2, Quantum of Solace, Guitar Hero: World Tour</em>, and so on. It was deja vu, and we found ourselves literally checking our badges to make sure we weren't at E3 2008. Note to Activision: You've got a captive audience sitting in seats and (mostly) paying attention -- take advantage of 'em!</div>

<a href="http://www.gamepolitics.com/2009/01/06/do-consumers-need-govt-protection-drm-it039s-agenda-ftc-conference">GamePolitics</a> is reporting that the <a href="http://www.ftc.gov">Federal Trade Commission</a> is ready to <a href="https://secure.commentworks.com/ftc-DRMtechnologies/">look into</a> "consumer protection" related to digital rights management tools. To many people, this may seem like a great idea. In general, it's not. It would be nice to give consumers some protection from some of the most draconian or <a href="http://en.wikipedia.org/wiki/2005_Sony_BMG_CD_copy_protection_scandal">horribly flawed</a> DRM systems that have been put into use. On the other hand, those of us who have been around the "government regulation" block know that these protections rarely solve the problem they set out to resolve, and in turn, generally put more hurdles in the way of those who want to get a product into the marketplace, which raises the cost of production and usually the consumer price, too. <br /><br />Consumer protection regulations do just what they sound like: they protect consumers. There are hundreds of these regulations at both the state and federal level in the U.S., and most are targeted at an industry level. There are consumer protections related to everything from debt collecting to auto repair to purchasing a franchised business. Many of these laws were enacted in response to a perceived or actual abuse by producers toward consumers. So, the government set out to level the playing field and to give consumers a way to deal with their grievances. In fact, there have been longstanding reports of gamers, generally, not being the most favored employee in some workplaces. Of course, as soon as anyone reads the word 'discrimination' they immediately think 'lawsuit.' Whether that's an unfortunate byproduct of the direction of the American legal system or something else entirely is a discussion for another day. <div align="left">The most treasured holiday figure, horrifyingly angry Santa, <a href="http://www.joystiq.com/2007/12/24/new-games-this-week-santa-hates-you-edition/">has returned</a> to wish you and yours a depressing, mediocre Christmas, where you'll spend more time mourning long-departed loved ones and watching <em>C.S.I.</em> reruns on grandma's couch than opening gifts.<br /><br />Also, he wanted you to know he's bringing you <em>Spore Comic Book Creator</em> and <em>Candace Kane's Candy Factory </em>on DS this week, so you can just put that in your chimney and smoke it. Oh, and he said that if you actually <em>do</em> have anything smoking in your chimney when he's trying to come down it, he's going to cut your brake lines and set your tree on fire.</div>

<br />I've talked about piracy in a number of <em>LGJ</em> pieces over the course of 2008. In most of those, I've criticized many approaches to stemming the tide of piracy, not only in games but in other related media as well. I'm not sure if I have any readers at the RIAA, but it appears the music industry has decided to opt for a strategy more in line with what I've described, according to the <a href="http://online.wsj.com/article/SB122966038836021137.html?mod=rss_whats_news_technology">Wall Street Journal</a> (via <a href="http://www.gamepolitics.com/2008/12/19/music-industry-gives-suing-consumers-will-pressure-isps-instead">GamePolitics</a>). It's definately a move in the right direction for a number of reasons, but would the same apporach work for the game industry? And would it be the right approach?<br /><br />Let's start by examining the reported new RIAA strategy, which really makes two key changes. First, it alters the strategy to request ISPs issue warnings to file sharers, and then those who continue stand to have their service cut off. The second change is that this strategy goes into action when the RIAA, to quote the article, 'finds a provider's customers making music available online for others to take.' In short, rather than focusing on the demand, they're focusing on the supply.
