The PS3 has the benefit of crossplatform games and a console that came before it to take the public's 'higher priced consoles are viable' virginity.

If it was by itself, there'd be even fewer games available, so this comparison doesn't really work.

I'd wager that instead of having a stricter certification process like the Microsoft and mandating this kind of feature, they let it slide (for now?) in order to get games out quicker for the console.
